Oceanic Empire Constitution

In the spirit of unity, justice, and progress, we, the people of the Oceanic
Empire, recognizing the inherent dignity and equal rights of all
individuals, and desiring to establish a sovereign and prosperous nation
built on the principles of liberty, democracy, and sustainable
development, do hereby adopt and enact this Constitution for the
governance of our great and diverse nation.

Inspired by the vastness of our oceans and the richness of our cultural
heritage, we commit ourselves to fostering a society that values
inclusivity, respects diversity, and upholds the principles of social and
environmental responsibility.

With this Constitution, we lay the foundation for a government that


serves the people, encourages innovation, and safeguards the natural
treasures that define our Oceanic identity.
In witness whereof, we, the people of the Oceanic Empire, do ordain and
establish this Constitution, binding ourselves and our posterity to the
principles and ideals herein proclaimed on this day.

TITLE I
CONSTITUTIONAL ELEMENTS OF THE NATION
The Oceanic Empire is a constitutional nation, full of rights and
justice. It is democratic and unitary within its members. It is
organized as a Monarchy and will be governed through a
decentralized system.
First Article: National anthem, emblem and anthem are the ones
established under this Constitution. They are our National Symbols.
Second Article: Fundamental duties of the Government:
● Warranty without any discrimination the safety of our fellow
citizens.
● Warranty and defend the sovereignty of the Nation.
● Ensure the wellness of our Citizens, that involves town
development.
Third Article: The Oceanic Empire’s territory constitutes a
geographical unity in Australia, as stated in the following: New
Guinea, Malay Islands, Oritigia, Gold Coast and Southern Australia;
according to the next map. To change the territorial organization
, only a constitutional amendment is needed
, an Extraordinary Constitution Amendment is needed.
Fourth Article: The capital city will be permanently located in New
Rotterdam. An Extraordinary Constitutional Amendment is needed to
change this.
Fifth Article: Each town will enjoy political and financial autonomy,
and shall be governed by the principles of solidarity and citizen
participation. Under no circumstances shall the exercise of autonomy
allow for the secession of national territory.
● Each town will have its own ruling and corresponding law as
long as it does not overrule this Constitution and rules within
their territory.

TITLE II
NATIONAL GOVERNMENT
Sixth Article: The Oceanic Empire will be formed by a democratic
monarchy. The King will be the highest legal authority, followed by
the Prime Minister, second highest national authority, who will have
under their command the Ministers they deem appropriate.
Seventh Article: Legislative Function - The Legislative Function
will be conducted by the House of Representatives, which will be
formed by Representatives elected for a period of 3 months. It is
unicameral and its headquarters will be located in New Rotterdam.
Representatives will be elected under the following dispositions:
● One representative elected by each state, with an additional 5
representatives chosen based on merit by the King. These
chosen representatives will hold the same legislative authority as
elected representatives, and the allocation of such
representatives shall aim to be one per state.
● To be elected as Representative, each candidate must have been
part of the Oceanic Empire for at least 1 month.
● Each candidate can be indefinitely and consecutively reelected.
● Impeached members of the House will not be able to participate
in new elections for 2 periods.
Eighth Article: The House of Representatives will have the
following attributions:
● Inaugurate the Prime Minister elected under the last elections
called by the Electoral Council. The Inauguration Day will be
held on the 15th or 30th day of the month the elections were
executed.
● Impeach the Prime Minister and remove him/her from Office.
● Participate in the process of amending this Constitution.
● Create, modify or delete taxes and laws.
● Concede amnesties or pardons for political crimes or
humanitarian reasons with the favorable vote of at least ⅔ of
Representatives.
● Function as the second Power of the Nation, hence being able to
declare war on other States, with approval from the King.
● Transfer their powers to the Prime Minister in cases required by
this Constitution.
Ninth Article: The House of Representatives will be able to impeach
the Prime Minister with the request of at least ⅓ of Representatives,
including, but not limited to the following cases:
● Crimes against National Security.
● Treason
● Bribery and corruption.
● Severe political crisis and internal unrest.
Tenth Article: The House of Representatives will create, modify or
delete taxes and laws. Laws can only be about the economy, security,
regulatory processes, and electoral system. They will not be about
town or individual regulation.
New laws or Constitutional amendments can only be directly
proposed by the Prime Minister , Ministers and Representatives.
Citizens can also propose Laws modifications, although they will
need the following requirements: a) Written amendment or proposal;
b) Written support of 20% of the nation's population.
If they fulfill these requirements, the Project of Law will be sent to the House of
Representatives for it to be treated and voted on.

Eleventh Article - House of Representatives Internal Organization: Representative

Voting: They will vote on every voting round the Chamber requires. If they

Twelfth Article: Voting requirements and methods.


The House of Representatives will need a certain amount of votes for
its actions:
● Modify the Constitution: Two thirds of the House.
● Create, modify or delete laws or taxes: Absolute majority (Half
plus one).
● Impeach the Prime Minister: Two thirds of the House.
● Impeach the Ministers of State: Absolute majority (Half plus
one).
● Extraordinary Constitution amendments: Unanimity of the
House.
● Declare war on other nations: Two thirds of the House.
● Provide absolute power to the Prime Minister: Absolute
majority (Half plus one).

Thirteenth Article - The Monarch: The Monarch shall serve as the


executive Head of State, embodying the unity and continuity of the
nation. The monarch's role is political, and their powers and functions
are subject to the provisions of this Constitution.
Fourteenth Article: The Monarch will have the following
attributions, in addition to those determined by law:
● Fulfill and enforce the Constitution, laws, international treaties,
and other legal norms within their competence.
● Define and lead the public policies of the Executive Function
along with the Prime Minister.
● Inaugurate the Electoral Councillors.
● Inaugurate the House of Representatives in a maximum period
of one week after the elections the new Representatives
participated in.
● The King shall play an active role in foreign affairs,
representing the nation in diplomatic matters, negotiating
treaties, and engaging in international relations. The King may
conduct official state visits and participate in diplomatic
initiatives to promote the interests of the country.
● Approval of budgets and economic policies. This involvement
shall be consistent with the overall economic framework
established by law.
● Define foreign policy, sign and ratify treaties with other nations.
Appoint and remove ambassadors in each nation if necessary.
● Call for general elections and popular consultations in cases the
Constitution requires and/or Prime Minister’s absence.
● Exercise the highest authority over the military and declare the
State of Exception or declaration of war according to what this
Constitution stipulates. However, operational control over the
military shall be exercised by appointed military officials under
the guidance of the King.
● Dissolve the House of Representatives in cases this Constitution
requires.
● Exercise veto power over new legislation.

Fifteenth Article - The Prime Minister: The Prime Minister


represents the second leader of the Executive Function, hence
politically responsible for the public administration. This authority
will be elected for a period of three months with the right to
indefinitely and consecutively reelect himself/herself.
● To be elected as Prime Minister, each candidate must have been
part of the Oceanic Empire for at least 3 months.
● Impeached Prime Ministers will not be able to participate in a
new election for at least 2 periods.
● The Constitution hereby grants the right for any individual, eligible to serve as Prime
Minister, to be indefinitely reelected, thereby waiving any restrictions on the number
of terms they may serve.

The Prime Minister will not be able to participate in the House of Represent

Sixteenth Article: These are the powers and duties of the Prime
Minister, in addition to those determined by law:
● Fulfill and enforce the Constitution, laws, international treaties,
and other legal norms within their competence.
● Present, at the time of their inauguration before the National
Assembly, the fundamental guidelines of policies and actions
they will develop during their term.
● Define the public policies of the Executive Function along with
the Monarch’s approval.
● Create, modify, and eliminate ministries.
● Propose the creation, modification and elimination of laws and
taxes. Send Law Projects to the House of Representatives.
● Call for general elections and popular consultations in cases the
Constitution requires.
● Exercise the Second highest authority over the military and
declare the State of Exception or declaration of war according to
what this Constitution stipulates.
● Request absolute power to the House of Representatives in case
of National security threats or State of Exception.

Seventeenth Article: The King will not be replaced under any


external circumstance. Only the resignation of the King will lead to
the Monarch’s vacancy. In case of definitive vacancy of this position,
the King will define his successor.
Eighteenth Article - Prime Minister vacancy: In case of temporary
or definitive absence of the Prime Minister, he/she will be replaced by
the Minister of Justice.
Under temporary absence of the Prime Minister, the Minister of
Justice will be in charge of the Nation until he/she is back. Under
definitive absence, he will take the charge until the period ends and
the next Prime Minister is inaugurated.
● It will be considered temporary absence in the following
instances: temporary ban, vacation/holiday, exam weeks, real-
life mishaps.
● It will be considered a definitive absence in the following
instances: Permanent ban, resignation, impeachment.
Nineteenth Article - Inverse Impeachment: The King or Prime
Minister (with the King’s approval) will be able to dissolve the House
of Representatives when, in their judgment, it has stolen functions
that do not constitutionally belong to it in the following cases:
● It obstructs the execution of the Prime Minister’s development
plan.
● Severe political crisis and internal unrest.
● Most of the Assembly has gone inactive (do not vote on things
or refuse to do it).
● Representatives being Kicked.
● National Security threats or treason from the House.
If an Inverse Impeachment proceeds, the Prime Minister will need the favorable opinion of
the King. In case all the requirements are fulfilled, the Representatives will be immediately
removed from power and the House will stop functioning. The King and Prime Minister will
take on the House’s duties until new elections are called.

This will only proceed in the first 2 months of the Prime Minister´s period, after th

Twentieth Article - Extraordinary Periods: If an inverse

impeachment proceeds, the Electoral Council will announce
new elections for the impeached authorities, who will function for the
rest of the respective period until the next authorities are inaugurated.
Twenty-first Article - Ministries: The Ministers of State will be
freely appointed or removed by the Prime Minister

● To be a Minister of State, the same requirements as The Prime Minister must be
fulfilled.

Twenty-Second Article: The House of Representatives may initiate


political impeachment, upon the request of at least one-fourth of its
members, for non-compliance with the functions assigned to them by
the Constitution and the law, of the ministers of State.
Censure will result in the immediate removal from office of the
Minister.

TITLE III
ELECTORAL COUNCIL

Twenty-third Article: The Electoral Council will guarantee citizen


participation and their political rights through voting. It will be
formed by onethree Councilors elected under the following
regulation:

Twenty-fourth Article: The Electoral Council will have the


following powers and duties:
● Organize, lead and ensure transparent electoral processes. Call
for elections, proclaim results and winners of the elections
according to Constitutional regulations.
● Control election propaganda and debates.
● Review and resolve issues related to any political organization
and candidacies.
● Propose legislative initiatives regarding the Electoral Function.
● Define the amount of Representatives to be elected in each
election.
● Keep permanent track of population statistics along with the
Prime Minister and the Ministers of Land and Recruitment.

Twenty-fifth Article: Elections will have the following regulations:


● Political Parties are allowed inside the Nation, although they
cannot support or be part of independentist, overthrowing/coup
or joke parties.
● Political parties must have at least two candidates per election to
function, otherwise their rights will be deleted. Hence they will
not be able to participate in any General election.

TITLE IV
INTERNATIONAL RELATIONSHIPS

Twenty-Second Article: Oceanic Empire’s relations with the


international community will respond to the interests of its people, to
whom those responsible and executors will be held accountable.
Accordingly:
● Advocate for the peaceful resolution of international disputes
and conflicts.
● Condemn state interference in internal affairs of other states and
any form of intervention.

Twenty-Third Article - Declaration of War: The King, Prime


Minister or House of Representatives have the sovereign right to
declare war on other nations.
● The declaration of war shall be proclaimed by the King only,
and requested by the King, the Prime Minister or the House of
Representatives. Both the Prime Minister and the House of
Representatives will need the King’s approval the declare war
on other nations.
● Before the formal declaration of war, the King and Prime
Minister with the National cabinet shall organize a commission
of the armed forces to analyze military strategy, geopolitical
analysis and financial needs. This commission will determine
the viability of the war.
● The Head of State will consult with leaders of key allies,
informing them of the intention to declare war or seeking help.
● After the declaration of war is proclaimed, all citizens will be
called for voluntarily joining the military in order to defend the
nation from the conflict or threat.
Twenty-Fourth Article - State of Exception or State of
Emergency: The King or Prime Minister may decree a state of
emergency throughout the national territory or in part of it in the
event of aggression, international or internal armed conflict, or serious
internal disturbance. The declaration of a state of emergency will not
interrupt the activities of the functions of the State.
Twenty-Fifth Article: Once a state of emergency is declared, the
King or Prime Minister may:
1. Decree the modification, creation or remotion of taxes without
favorable procedure from the House of Representatives.
2. Utilize public funds in his/her opinion.
3. Move the government headquarters to any location within the
national territory.
4. Impose prior censorship on information related to the reasons
for the state of emergency and the security of the State.
5. Establish the entire or partial national territory as a security
zone.
6. Order the deployment of the Armed Forces.
7. Order the closure or opening of ports, airports, and border
crossings.
8. Decree the modification of the national territory for security
reasons and safety of its people.
9. Request absolute power to the House of Representatives until
the conflict or cause of the State of Exception ends.
TITLE V
INTERNAL ORGANIZATION

Twenty-Sixth Article: Besides participating inside the political


system of The Oceanic Empire, it is expected as well that mayors and
other active members participate in the states chats with other mayors
to propose laws and representation, as well as taking part in some
local projects.
For this apart from the state chats, there will be a mayor-registry chat
where the state and the common citizen can coordinate and
communicate with your average town mayor.

TITLE VI
CONSTITUTIONAL REGULATIONS
Twenty-Seventh Article - Constitutional Locks: There will be
sections in this Constitution that will not be able to be amended unless
all the Government powers approve it with unanimity.
These will be the Constitutional locks:
● Articles: First, third, fourth, sixth, thirteenth, fifteenth, twenty-
third, twenty-seventh.
To modify these Constitutional locks, these requirements will be
fulfilled:
● Unanimity of the House of Representatives
● Approval of the King and Prime Minister.
● Approval of the Electoral Council lor.
● General Elections: >50% of favorable results.

TITLE VII
TRANSITIONAL POINTS

In this constitution it is concealed that every citizen will follow the


legal code, the constitution and the authorities if it's local or state
wide.

The breaking of the laws inside the penal code might result in
expulsion, suspension from Oceanic circles, and other consequences
the authorities or the minister of justice might want to take.

Transitional points:

● The King, within a maximum period of fifteen days from the


effective date of this Constitution, shall call for elections of
Prime Minister, House of Representatives and Electoral
Council.
● All candidates for the Electoral

Council will be elected under a shortlist of three candidat

Council, due to being a transitional period, will be elected

● Reorganization of the Discord chats and roles within a


maximum period of 15 days from the effective date of this
Constitution.
● The new Oceanic organization will be published along with this
constitution and it is expected for everyone to present
themselves in their state.
● The provisional Government and House of Representatives will
rule until the inauguration of the next authorities according to
the Eighth Article of this Constitution.
