AN ORDINANCE REGULATING PARKING ALONG VARIOUS STREETS, ROADS, AND


HIGHWAYS WITHIN THE TERRITORIAL JURISDICTION OF THE CITY OF KORONADAL

EXPLANATORY NOTE
In order to resolve the existing traffic fiasco in the city due to disorganized parking situations and
the uncontrollable volume of motor vehicles going to and through the city most particularly within
Benigno Aquino Street, Sergio Osmeña Street, Juan Posadas Street, Manuel Roxas Street, Jaycee
Avenue, Rizal Park and the surrounding of Koronadal Public Market.
The City Government of Koronadal will provide effective and efficient traffic management in
various streets, roads and highways within the territorial jurisdiction of the City. The City Traffic
Management Office (CTMO) is required to implement in a stringent and vigilant manner this Ordinance
alongside other traffic laws and regulations of the City Government of Koronadal.
The Department of Interior and Local Government released Circular No. 2019-193 directing local
government units to responsibly exercise the authority granted by law to regulate the use of streets,
avenues, alleys, sidewalk, park and other public place within their areas of jurisdiction, as well as
sustain the efforts that have already been undertaken relative to road clearing and safety.
Section 458(5)(vi) of Republic Act No. 7160, otherwise known as the Local Government Code of
1991, which mandates local governments to “Regulate traffic on all streets and bridges; prohibit
encroachments or obstacles thereon, and when necessary, in the interest of public welfare, authorize
the removal of encroachments and illegal construction in public places.”
Section 458(5)(v) of Republic Act No. 7160, mandates local governments to “Regulate the use of
streets, avenues, alleys, sidewalks, bridges, parks and other public places and approve the construction,
improvement, repair and maintenance of the same, establish bus and vehicles stops and terminals or
regulate the use of the same by privately-owned vehicles which serve the public; regulate garages and
the operation of conveyances for hire...xxx.”
Section 132 of Republic Act No. 7160, the Local Government Unit has the power to impose tax,
fee or charge or to generate revenue, in this case, the Local Government of Koronadal is mandated to
create its own sources of revenue subject to the conditions set forth by the Code and consistent with the
basic policy of local autonomy.
Consistent with Section 130 (b) of the same Code, the parking fees to be imposed by the
Sangguniang Panlungsod of Koronadal City are determined to be:
1. Equitable and based as far as practicable on the taxpayer’s ability to pay;
2. Levied and collected only for public purposes; and
3. Not unjust, excessive, oppressive or confiscatory, contrary to law, public
policy, national economic policy or in the restraint of trade xxx;
Under Section 46, 52 and 54 of the Republic Act No. 4136 also known as the Land
Transportation and Traffic Code of the Philippines, it prescribes the road safety and prevention road
accidents in the streets, and mandates local government units to classify roads within their jurisdiction
for the traffic decongestion purposed;

Hence, this Ordinance:


SECTION 1. SHORT TITLE. This Ordinance shall be known as “PARKING REGULATION ORDINANCE
OF THE CITY OF KORONADAL”
SECTION 2. DECLARATION OF POLICY. It shall be the policy of the City of Koronadal to regulate
vehicles in throughfare and traffic to ensure that:
The traffic flow in the City of Koronadal is decongested and stabilized by regulating the parking,
unloading and loading activities for all kinds of vehicles particularly along City Streets, General Santos
Drive and Alunan Avenue. Further, in accordance with the existing and transportation laws, it is hereby
declared the city’s policy to prohibit parking along national highways within the territorial jurisdiction of
the City.
SECTION 3. DEFINITION OF TERMS. The following terms used in this Ordinance shall mean:
a. Fee - charge fixed by the Sangguniang Panlungsod through this Ordinance for the use
of parking spaces determined heretofore;
b. Immediate Surrounding Area - the area in the urban center;
c. Motor Vehicle - all vehicles run by engine whether the same is offered for passengers
or for cargoes of whatever kind or nature;
d. Overnight Parking - parking in the parking areas after office hours or from 8 o’clock in
the evening (8:00PM) to 5 o’clock in the morning (5:00AM)
e. Parked Vehicle - the state of the motor vehicle that is stationary for the period within
which said vehicle is not limited to the time needed to pick up or set down persons or
goods and remains inactive in that place for an appreciable period of time;
f. Parking - when a motor vehicle of whatever kind is stopped on any portion of the road
or vacant lot/space and/or any activity involving the use of the vehicle.
g. Parking area - the area set or determined by the Sangguniang Panlungsod through this
Ordinance as suitable for parking;
h. Validation - the checking or proving by the Department /Agency/Bureau Head of office
located within the urban center of the City of Koronadal or any of its authorized
representative/s concerned, of the validity or accuracy of the specific business
transaction undertaken by the owner of the vehicle parked in the parking area for the
purpose of claiming exemption form the implementation of this Ordinance.
i. Loading - an act of a person or thing that loads in the vehicle, which used the vehicle
stationary for at least 2 minutes.
j. Unloading - an act of removing goods or cargo from a vehicle, which used the vehicle
stationary for at least 2 minutes.

SECTION 4. COVERAGE. This Ordinance shall cover all types of vehicles whether public or private
within the territorial of jurisdiction of the City of Koronadal.

SECTION 5. NO PARKING ZONES. All designated no parking throughfares including General Santos
Drive and Alunan Avenue will be no parking anytime. The area will be painted RED.

SECTION 6. PROHIBITED ACTS – It shall be unlawful for any person:


1. To park any vehicle along National Highways, particularly General Santos Drive
and Alunan Avenue including Road Right of Ways.
2. To park any vehicle across any line or marking of a parking space or in such
position that the vehicle shall not be entirely within the area designated by such
lines or markings;
3. To unload their cargoes/passengers outside the designated loading and unloading
zones;
4. To tamper or damage any vehicle, other than his own, parked in the same parking
facility;
5. To park any vehicle for the purpose of washing, cleaning, greasing, painting,
selling merchandise or repairing or installing any accessories and/or tinting, except
repairs necessitated by an emergency on a designated area in the parking facility;
6. To display for sale or to sell goods and merchandise;
7. To park their vehicles not parallel, vertical and pedicular to the designated parking
area/space;
8. To double park their vehicles around ___;
9. To refuse to pay the parking fee/charges herein enumerated;
SECTION 7. DESIGNATED PUBLIC PAY PARKING ZONES AND MODE OF PARKING.

a. The City Traffic Management Office is hereby authorized and directed to establish, mark and
designate portions of a thoroughfare as on-street public pay parking zones.
b. The streets listed below are hereby designated as either one-sided or two sided on-street
public pay parking zones.
 Infront of City Public Market – Perpendicular Parking
 Junction of Alunan Avenue and Osmeña Street - Perpendicular Parking
 Junction of Alunan Avenue and Antipolo Street - Perpendicular Parking
 Junction of Osmeña – Posadas Street - Perpendicular Parking
 Junction of Posadas – Morrow Street – Parallel Parking
 Junction of Aquino - Osmeña Street - Parallel Parking
 Junction of Aquino – Morrow Street - Parallel Parking
 Junction of Jaycee Avenue and Rizal Street – Vertical Parking
 Along Waling-waling Street particularly beside of Rizal Park – Vertical Parking

c. The determined parking spaces to be subject to the imposition of parking fees shall be
painted YELLOW.

d. Pay parking shall commence at 6:00 A.M. to 8:00 P.M. and the overnight parking shall begin
at 9:00 P.M. to 5:00 A.M. from Monday to Saturday.

SECTION 8. IMPOSITION OF PARKING FEES. The following parking fees shall be imposed:

SECTION 9. EXEMPTION/DISCOUNT IN THE PAYMENT OF PARKING FEE. The imposition of


parking fees mandated by this Ordinance shall be subject to exemption/discount set forth below:
I. EXEMPTION. The following persons/entitles shall be exempted from the implementation of
this Ordinance:
a. Guests for any special activities/events, e.g., Hinugyaw Festival and T’nalak
Festival;
b. Group on Educational Tour; and
c. In case of force majeure occurrence that includes:
c.1. Natural Causes (Fire, Storms, Floods);
c.2. Governmental or societal actions (war, invasion, civil unrest, labor strikes);
c.3. Infrastructure failures (transportation, energy), etc.

II. DISCOUNT. The following persons/entitles shall be entitled to discounts from the imposition
of parking fees:

a. SENIOR CITIZENS Twenty Percent (20%)


b. PWDs Twenty Percent (20%)
SECTION 10. COLLECTION OF PARKING FEES. Parking ticket containing the Control Number, Date,
Plate Number, Time of Entry and Time of Exit shall be issued by an authorized collection agent of the
City Government. The City Treasurer or his or her authorized Representative is hereby empowered to
collect herein parking fees using any form of official receipt he may devise, from the conductor, driver,
operator and/or owner of vehicles parked in said designated parking areas and the same shall be
recorded on a separate subsidiary ledger. Any officer of the CTMO may be allowed to collect parking
fees provided they are duly authorized by the City Treasurer after complying with the mandatory
requirements under the law, e.g.: bond.

SECTION 11. DESIGNATED PUBLIC MARKET TRICYCLE TERMINAL. Each TODA shall utilize the
existing shed used as designated terminals around the Koronadal City Public Market.

Any excess tricycle who parked in the said designated terminals shall be penalized accordingly.
Each TODA must have a licensed dispatcher to manage the operations of their terminal. Dispatchers
shall see to it that only three tricycles are parked at a time.

SECTION 12. DESIGNATED LOADING/UNLOADING ZONES. The following area shall be designated
as loading/unloading zones:
a. Loading Zones with designated color Orange:
a.1. In-front of KCC Orange Gate
a.2. In-front of KCC Blue Gate
a.3. In-front of Ace ___ Gate
a.4. In-front of Ace ___ Gate

b. Unloading Zones with designated color Yellow GREEN:


b.1. In-front of KCC Orange Gate
b.2. In-front of KCC Blue Gate
b.3. In-front of Ace ___ Gate
b.4. In-front of Ace ___ Gate

c. No Parking Areas:
c.1. Signage White and Red – No Parking anytime

Loading and unloading of cargoes and/or passengers must be done within 2 minutes at the most,
behind this period the apprehending officer shall have a discretion to determine the necessity of
extension the period of loading or unloading.
SECTION 13. RESPONSIBITIES OF THE CITY TRAFFIC MANAGEMENT OFFICE. The CTMO shall
facilitate the overall implementation of the provision of the Ordinance and individual
apprehension of violators, subject to deputize requirements by law.
SECTION 14. PENAL PROVISION. The following penalize shall be imposed upon violators of this, to
wit:
1. Violation of Section _ of this Ordinance (non-parallel parking) subject the violator with
an Administrative Fine of One Thousand (P1,000.00) Pesos.
2. Violation of Section _ (a), (c),(d) and (e) of this Ordinance (illegal unloading) shall
subject the violator with an Administrative Fine of Five Hundred (P500.00) Pesos.
3. Violation of Section _ (b) of this Ordinance (illegal parking) shall subject the violator
with an Administrative Fine of One Thousand (P1,000.00) Pesos.
4. Violation of Section _ (f) of this Ordinance (double parking) shall subject the violator
with an Administrative Fine of One Thousand (P1,000.00) Pesos.
5. Violation of Section _ of this Ordinance shall subject the tricycle driver violator with an
Administrative Fine of One Thousand Five Hundred (P1,500.00) Pesos.
6. Allowing the excess unit in the terminal shall be a ground for the cancellation of the
right to use of the TODA over the designated terminal.
7. Violation of Section _ of this Ordinance shall subject the TODA to an Administrative
Fine of One Thousand Five Hundred (P1,500.00) Pesos.
8. Violation of Section _ of this Ordinance shall likewise cause the forfeit the right of the
TODA and its members to use the designated terminal.
9. Violation of Section _ of this Ordinance shall subject the drive/or owner of the private
tricycle an Administrative Fine of One Thousand (P1,000.00) Pesos.
10. Violation of Section _ of this Ordinance shall cause the confiscation of the signages.
SECTION 15. Budgetary Requirements. – An initial amount of Five Hundred Thousand Pesos
(P300,000.00) Pesos shall be provided for the paintings and provision of signages.
SECTION 16. IMPLEMENTING RULES AND REGULATIONS. The Implementing Rules and
Regulations shall be prepared by the CTMO within one (1) month after the approval of
this Ordinance, subject to the approval and adoption of the Sangguniang Panlungsod.
SECTION 17. SUPPLETORY APPLICATION. The provisions of R.A. 4136 and other laws relating to
traffic rules and regulation shall be applied suppletory to this Ordinance.
SECTION 18. REPEALING CLAUSE. Any Ordinance, Rule or Regulation or part thereof which is
inconsistent with any provision of this Ordinance is hereby repealed or modified
accordingly.
SECTION 19. EFFECTIVITY. This Ordinance shell take effect fifteen (15) days after publication.
