Get money that's


been paid into the
Court Funds Office
You can ask for money owed to you that’s held in
the Court Funds Office. Related content

It will be money a defendant paid in (/pay-court- Pay money into the


funds-office) either: Court Funds Office
(/pay-court-funds-office)
to use a defence that they made an offer to settle
before the case started and you turned it down
(sometimes called a ‘defence of tender before
claim’)
when the court has ordered them to pay it in as
part of a settlement that you’ve accepted
as part or all of a ‘part 36 offer’ to settle made
before April 2007 but you’ve only now accepted it

You can ask for the money to be paid into either:

your bank account


your solicitor’s bank account

If you have legal aid charges to pay, the money


must be paid into your solicitor’s bank account.

Money paid in as part of a defence of


tender before claim or a settlement
you’ve accepted

Apply to get money you’re owed by sending the


Court Funds Office both:

a request for payment (CFO 201)


(/government/publications/court-funds-ask-for-
payment-for-a-part-36-offer) signed by you or your
solicitor - if you sign it, your signature must be
witnessed
a notice of consent (CFO 202)
(/government/publications/court-funds-notice-of-
consent-to-pay-out-of-money-in-court) signed by the
defendant or their solicitor - if the defendant signs
it, their signature must be witnessed

Include a copy of a bank statement or letter from


your bank dated within the last 3 months if you want
the money paid into your bank account rather than
your solicitor’s.

days if they approve your request.

Money paid in as part of a ‘part 36


offer’ to settle before April 2007
Apply to get money you’re owed by sending the
Court Funds Office a request for payment (CFO
