PETITION FOR DIVORCE BY MUTUAL CONSENT U/s.13(B)


OF THE HINDU MARRIAGE ACT, 1955

1. The petitioner is Mr. Kawin Paul, S/o. Paul, Hindu, aged


about 37 years, residing at No.F3, Thiruthanigai
Apartments, No.118/9, Vanniyar Street, Narayana
Puram Main Road, Morning Star School Back Side,
Choolaimedu, Chennai – 600 089.

2. The Second petitioner is Mrs.M. Srividhya, W/o. Kawin


Paul, Hindu, aged about 35 years, residing at Np.F3,
Thiruthanigai Apartments, No.118, Vanniyar Street,
Narayanapuram Main Road, Morning Star School Back
Side, Choolaimedu, Chennai – 600 094.

3. The address for service of all notices and process to the


petitioners is an stated above.

4. The petitioners state that the marriage between the 1st


petitioner and 2nd petitioner was solemnized on ……… at
…………………………………………………………………………
as per Hindu Rites and Customs and marriage was an
love cum arranged marriage. The petitioners state that
they led the matrimonial life in the same place and
during that period there were several mis understanding
an account of the temperament and the petitioners were
in compitable and they began to live separately since
June 2023.

5. The petitioners submit that out of their wedlock they


have no issues.

6. The petitioners submit that dispite best efforts of


relatives, well wishes and elders they have not been able
to compose their differences and the petitioners have
decided to marriage has broken down irretrievably and
they cannot live together and agreed that the marriage
should be dissolved.

7. The petitioners submits that they have taken back their


articles and they have not claimed. The 2nd petitioner
has not claim any maintenance against the 1st petitioner
is present and future.

8. The petitioners said that they have absolutely no claim


against each other and the efforts taken for reunion
proved futile and the marriage between the petitioners
have irretrievably for reunion and they have decided to
leave as friends. Hence, the present petition for divorce
by mutual consent.

9. The petitioners further state that there is no collusion or


fraud or coercion or undue influence between them in
filing this petition.

10. No fraud or threat is played upon by each other in


obtaining the signature in this petition.

11. There is no similar petition filed or pending before any


other court of law.

12. The cause of action for this petition arose at Chennai,


within the Jurisdiction of this Hon’ble Court, where there
petitioner lastly resided on …………………, when the
marriage between the petitioners were solemnized at
……….………………………………………………………………..
as per Hindu Rites and Customs and during 2013, when
the petitioners had started their matrimonial life at
T.Nagar, Chennai – 17 is rented house and on during
2019, when the second petitioner purchased the flat at
the present address and the second petitioner left the
matrimonial home and started to live I the present
address and the petitioners lastly resided within the
jurisdiction of this Hon’ble Court.

13. The petitioners state that they pay fixed Court Fee of
Rs……. /- (Rupees ………………………… Only) under
article I, Schedule II of TamilNadu Court Fees and Suit
Valuations Act.

The petitioners therefore pray that this Hon’ble Court


may be pleased to pass Judgment and Decree:

(a) To dissolve the marriage solemnized between the


petitioners on and
(b)Pass such future or order or other orders of this
Hon’ble Court may deem fit and proper in the
circumstances of the case.
