MOST RESPECTFULLY SHEWETH:-

1. That the petitioners are peace loving people of the locality of Laketown
Saktigarh , P.O. , Under P.S. N.J.P Dist Jalpaiguri where they used
to reside with their family members with Honour for long period.

2. That one Kalpana Biswas W/o. Prasenjt Biswas residing at Bhola more,
Ghorar Bari near Shani mandir, P.O. Sahudangi Hat , P.S. N.J.P, District
Jalpaiguri lodge one complaint against this accused petitioners.

3. That the said complain inter alia is that :

“de-facto complainant’s husband i.e. Prasenjit Biswas who is the


principal accused of the case Physically assaulted & demand of
dowry to the de-facto complainant as per the direction of the
petitioners.”

4. That out of such complain N.J.P. Police Station started a case against this
accused person bearing N.J.P Police Station case No. 181/2024 dated
04.03.2024 under section 498(A)/323/506/ I.P.C. R/W Sec 3 /4 Dowry
Prohibition Act corresponding G.R. Case No. /2024.

5. That the petitioner is innocent to the charge as made by the complainant the
instance of rivals.
And the petitioners are permanent resident of the Laketown
Saktigarh , P.O. , Under P.S. N.J.P Dist Jalpaiguri And there is no
change of there absconding and/or tempering with the evidence in they are
allowed anticipating bail.

6. That the petitioners have reasonable apprehensions that they may be


arrested on the acquisition of having committed that alleged non-bailable
offence as noted above.

7. That the petitioner have not file any petition before Hon’ble High Court,
Calcutta for their bail beside the present petition for anticipatory bail.
An affidavit is filed herewith.
8. That the petitioner have filed the petition for anticipatory bail with a view
to avoid the arrest and harassment in connection with the above noted case.

In the above circumstances, it is humble prayed
that your Honour would be pleased to admit the
petition, call for records and after hearing the
petitioners and the learned public prosecutor for the
state be further pleased to direct the Police officer
concerned to release the petitioners on bail in the
event of their arrest in connection with the above
noted case and that on terms and conditions as your
honour deem fit and proper.

And your petitioners as in duty bound shall ever pray.

AFFIDAVIT

We, (1) Pradip Biswas aged about 69 years S/O. Late Suresh Biswas (2) Smt.
Sandhya Biswas aged about 69 Years W/o. Pradip Biswas both are residing at
Laketown Saktigarh, P.S. N.J.P. District Jalpaiguri do here by declare as follows:-

1. That we are the presence petitioners of above noted case.


This is true to the best of our knowledge and belief.

2. That we have not filed any bail application U/S. 438 Cr.P.C, before the
Hon’ble High Court, Calcutta or any other Courts except this application in
connection with the N.J.P Police Station case No. 181/2024 dated
04/03/2024, U/S 498(A)/323/506/34 I.P.C. R/W Sec 3/ 4 Dowry Prohibition
Act corresponding G.R. Case No. /2024.

This is true to the best of our knowledge and belief.
