LEAVE AND LICENSE AGREEMENT

This agreement is made and executed on this 6th day of June, 2021 at Jaipur,
Rajasthan.
BETWEEN
Ajay Mistry aged about 40 years, s/o Cyrus Mistry r/o Plot no.73, Maharani
Farm, Jaipur PAN: CLQ174825, hereinafter referred to as the “Licensor” which
expressions mean and include his heirs, successors, assigns, executors and
administrators.
AND
Ratan Sharma aged about 36 years, s/o Pankaj Sharma r/o Plot no. 93, Surya
Nagar, Jaipur PAN: CLQ17462, hereinafter referred to as the “Licensee” which
expressions mean and include his heirs, successors, assigns, executors and
administrators.

WHEREAS the Licensor is absolutely seized and possessed of the Premises


more described in detailed in Schedule hereunder (“Premises”) and is desirous
of giving the said Premises on Leave and License to the Licensee.

AND WHEREAS the Licensee herein is in need of temporary Premises for his
use have approached the Licensor with a request to allow the Licensee herein to
use and occupy the said Premises on Leave and License basis for a period of
Nine months commencing from 01.07.2021 and ending on 31.03.2022, on terms
and subject to conditions hereafter appearing.

AND WHEREAS the Licensor has agreed to allow the Licensee herein to use
and occupy the said Premises for the purposes of residential use only, on Leave
and License basis for above mentioned period, on terms and subject to
conditions hereunder;

NOW THEREFORE IT IS HEREBY AGREED TO, DECLARED AND


RECORDED BY AND BETWEEN THE PARTIES HERETO AS UNDER: -

1) Period: That the Licensor hereby grants to the Licensee herein a revocable
leave and license, to occupy the Premises, for a period of 9 months
commencing from 01.07.2021 and ending on 31.03.2022. The licensor does not
create any tenancy rights, title or interest in favor of the Licensee.

2) Rent & Deposit: That the Licensee shall pay to the Licensor Rs.20,000 Per
month towards the rent. The said amount should be paid by the Licensee on
the 1st day of every month without any default. The licensee shall bear all the
outgoing expenses, electricity bills, telephone bills, internet charges, water
charges himself without any default.

Interest free refundable deposit, for the use of the said Premises. The amount
of monthly compensation shall be payable within first five days of the
concerned month of Leave and License.

The Licensor acknowledges the receipt of the Security Deposit of Rs.


40,000. /-This amount of security deposit will be retained by the Licensor.
And after expiration or sooner determination of the agreement, the licensor
shall hand over the security deposit back to the Licensee within 10 days of
Licensee removing himself and his goods and belongings from the Premises.
Licensor should not charge any interest on the refundable security deposit
amount

3) Payment of Deposit: That the Licensee have shall pay the above-mentioned
deposit as mentioned above by Cash.

4) Maintenance Charges: That the Licensee herein shall bear and pay all the
maintenance charges in respect of the said Premises, and other outgoings
including all rates, taxes, levies, assessment, non-occupancy charges, etc. in
respect of the said Premises shall be paid by the Licensor.

5) Use: That the Premises shall only be used by the Licensee for residential
purpose only. The Licensee shall at his own cost and expenses keep and
maintain the interior of the Premises in good condition. Reasonable wear and
tear are acceptable. The Licensee shall not indulge in any practice in the said
Premises which is or is likely to become a nuisance or annoyance or in any
way interfere with the quiet or comfort of the Licensor and other occupants
of the Premises. The rights of Licensor in respect of said Premises or shall not
do any unlawful activities prohibited By State or Central Government.

6) Alteration: That the Licensee shall not make or permit to do any alteration or
addition to the construction or arrangements (internal or external) to the
Premises without previous consent in writing from the Licensor.

7) No Tenancy: That the Licensee does not have any tenancy right and shall not
have any right to transfer, assign, and sublet or grant any license or sub-
license, mortgage or raise any loan against the Premises.

8) Inspection: That, the Licensor and his agents should be granted by the
Licensee the right to enter, view and inspect the Premises after giving at least
a 48 hours prior notice with reasonable grounds.

9) Cancellation: That, if the Licensee commits default in regular and punctual


payments of monthly compensation as herein before mentioned or commit/s
breach of any of the terms, covenants and conditions of this agreement or if
any legislation prohibiting the Leave and License is imposed, the Licensor
shall be entitled to revoke and / or cancel the License hereby granted, by
giving notice in writing of one month and the Licensee too will have the right
to vacate the said Premises by giving a notice in writing of one month to the
Licensor as mentioned earlier.

10) Possession: That on the expiration or termination or cancellation of this


agreement the Licensee shall immediately vacate the Premises without any
delay with all his goods and belongings. In the event of the Licensee failing
and / or neglecting to remove himself and / or his articles from the said
Premises on expiry or sooner determination of this Agreement, the Licensor
shall be entitled to recover damages at the rate of double the daily amount of
compensation per day and or alternatively the Licensor shall be entitled to
remove the Licensee and his belongings from the Premises, without recourse
to the Court of Law.
11) Registration: The agreement should be registered and Licensee should
bear all the cost towards stamp duty and registration fees.

Plots no. A-98, situated at Raja Park, Jaipur measuring 734.39


sq. yds. (approx.) comprised of Khasra Nos. 20/5 and 25/2,
Village Hathroi, Jaipur; allotted by the Jaipur Development
Authority and bounded as under: -

On the North by- an empty plot;

On the South by- a 20.6 mtr. Wide road;

On the West by- Building Structure by the name of Sun &


Moon; and

On the East by- vacant plot of land.

IN WITNESS WHEREOF the parties hereto have set and subscribed their
respective signatures hereto in the presence of witness, who are identifying
the executants, on the day, month and year first above written.
