The Anti-Rape Act of 1997 or Republic Act No.

8353 (September 30, 1997)

 AN ACT EXPANDING THE DEFINITION OF THE CRIME OF RAPE, AMENDING FOR


THE PURPOSE ACT NO. 3815, OTHERWISE KNOWN AS THE REVISED PENAL CODE,
AND FOR OTHER PURPOSES.

It's important to recognize that anyone, regardless of gender, can be a victim of rape.

Types of Rape

Rape can occur through various means, including:


Force, threat, or intimidation.
Victim's unconsciousness or incapacitation.
Fraudulent manipulation or abuse of authority.
Sexual assault, involving penetration of mouth, anus, or genitals without consent.
Rape by Sexual Assault: This involves inserting the penis into another person's
mouth, anus, or genitalia without consent. It also includes using any instrument or
object for such penetration.

The law extends protection to victims under 12 years old or those who are mentally
incapacitated, even if the aforementioned circumstances are not present.

Legal Protection:
The penalty varies depending on the act itself and the circumstances surrounding it.

1. Reclusion Perpetua (Imprisonment from 20 to 40 years) is imposed on the offender if rape is


committed through sexual intercourse.
2. Prision Mayor (Imprisonment from 6 to 12 years) is imposed on the offender if rape was committed
through oral or anal sex or through the use of any object or instrument that was inserted into the
mouth or anal orifice of the woman or a man.
3. This may also be elevated to Reclusion Temporal (Imprisonment from 12 to 20 years) or
4. Reclusion Perpetua - penalty for thirty years, unless such person by reason of his conduct or some
other serious cause shall be considered by the Chief Executive as unworthy of pardon or life
imprisonment.
