APPLICATION TO FIX A DATE FOR PROSECUTION EVIDENCE AND
ISSUE PROCESSES TO THE WITNESSES
MOST RESPECTFULLY SUBMITTED:
1. That the instant case bearing Cr. Case No. 123/2023 is in trial and this court
was pleased to frame the charges vide order dated 11.02.2024 against the
accused person u/s 34, 302,307,325 and 339 of the Indian Penal Code, 1860.
2. That the plea was taken on the same date and the accused pleaded not guilty.
3. That this Court heard both the parties and framed the charges as above
mentioned.
4. That now the prosecution seeks the opportunity to present the evidence.
5. That this application is filed under section 321 of CrPC, 1973 to fix and
decide upon the date for leading the evidence for prosecution and to issue
process for the summoning prosecution witness.
6. That the list of witnesses is annexed as Annexure A.
PRAYER
In the light of the facts started and issues raised, it is humbly prayed before this
Court to adjudge and declare:
a. To allow the application
b. To fix the date for prosecution evidence,
c. To issue summon to the prosecution witness and/or
d. Pass any other order in the interest of justice, equity and good consciousness.
