1. That the offender enters a warship, fort, or naval or military
establishment or reservations.
2. That he has no authority therefor.
3. That his purpose is to obtain information, plan, photographs, or
other data of a confidential nature relative to the defense of the
Philippines.

in a regular or special session, except in case such member has
committed a crime punishable under the code by a penalty higher

2. That the person assaulted is a person in authority or his agent.
3. That at the time of the assault the person in authority or his agent
(a) is engaged in the actual performance of official duties (motive
is not essential), or that he is assaulted (b) by reason of the past
performance of official duties (motive is essential).
4. That the offender knows that the one he is assaulting is a person
in authority or his agent in the exercise of his duties (with intention
to offend, injure or assault).
5. That there is no public uprising.
