SUMMARY OF FACTS

 Loki, a recent MBA graduate with a stellar academic record, struggled to find suitable
employment despite his qualifications.
 While taking a break at a tea stall, Loki met Goggy, who suggested he explore a company
called Naukridekho for job opportunities.
 Naukridekho claimed to assist job seekers by embellishing their resumes with fake
experience letters and diploma certificates to attract potential employers.
 The organization also promised to arrange interviews with multinational corporations
(MNCs), albeit for a fee.
 Upon arriving at Naukridekho, Loki met Pinkul at the reception, who promised him a job
with a minimum salary of 10 lakhs per annum within three months.
 Pinkul requested a fee of 50,000 to expedite the process, which Loki agreed to pay in
cash the next day.
 When Loki asked for a receipt as proof of payment, Pinkul refused, citing the illegality of
their activities.
 Two weeks later, Loki returned to Naukridekho to follow up on his job application, only
to find a new receptionist who had no record of his enrollment.
 Loki argued with the receptionist, insisting he had paid the fee, but it became clear that
Pinkul had defrauded him by absconding with the money.
 Feeling distraught, Loki and his friend Ferry decided to seek revenge on Pinkul.
 They manipulated a photo of Pinkul to appear inappropriate using an AI tool called "FAT
GPT" and sent it to her, along with a request for a one-night stand.
 Pinkul, upset by the message, informed her fiancé Zafer about the incident.
 Zafer, accompanied by four friends, confronted Loki at his home, resulting in a violent
altercation where Loki was seriously injured.
 Zafer emasculated Loki with a knife during the altercation.
 Loki was hospitalized, and a case of grievous hurt was filed by the police.
 After the arrest of all involved parties, including Zafer, they were acquitted by the Court
of Session due to insufficient evidence, leading to Loki's disillusionment with the justice
system.
 Frustrated by the lack of justice, Loki decided to take matters into his own hands and
seek revenge.
 Zafer hosted a party with his friends, including Pinkul, where they indulged in dancing,
drinking, and illegal drug use.
 Loki and Ferry unexpectedly arrived at the party, leading to a tragic sequence of events.
 Loki fatally struck Zafer with an iron rod, resulting in his death.
 Ferry used a gun to harm Zafer's friends, leaving only Pinkul alive and frightened.
 Loki then instructed Ferry to brutally rape Pinkul while he recorded the assault on video.
 Subsequently, Loki forcefully inserted a 20-inch rod into Pinkul's private part, causing
her extreme pain and rendering her unconscious.
 Pinkul was left lying on the floor without clothing and with the iron rod inside her.
 Loki uploaded the video of the assault to porn websites and social media platforms with a
message implying a lack of faith in the justice system.
 The following morning, Zafer's servant discovered the gruesome scene at Zafer's house,
with Zafer and his friends dead and Pinkul severely injured.
 Despite efforts to save her, Pinkul succumbed to her injuries after 20 hours on a
ventilator.
 Zafer's father filed a FIR at the police station, charging Loki and Ferry with murder, gang
rape, grievous hurt, and house trespass at night.
 The case was transferred to the Central Bureau of Investigation (CBI) three days later.
 Pinkul's autopsy report revealed multiple injuries in her vaginal cavity, ovaries, uterus,
and nearby areas. She was intoxicated at the time of her death, and semen samples found
in her vaginal cavity belonged to Zafer, not Ferry.
 CBI officer Mr. D'Souza apprehended Loki and Ferry 1200 kilometers away from the
crime scene, working as laborers on a farmer's property. They possessed forged Aadhar
cards.
 The court granted a four-day police custody period for further investigation, rejecting bail
applications from both accused.
 The police report was filed 80 days after the arrests, leading to six months of court
deliberations.
 The court ultimately sentenced Loki and Ferry to life imprisonment.
 Dissatisfied with the verdict, Zafer's father appealed to the High Court of Flora, seeking
capital punishment for both Loki and Ferry.
 The defense argued that there was insufficient evidence to prove that Ferry had raped
Pinkul, citing the potential for video manipulation using AI tools and the absence of a
semen sample in Pinkul's autopsy report.
 They questioned why the benefit of doubt was not extended to Ferry and Loki, given
these uncertainties.
 Furthermore, the defense contended that the circumstances surrounding the events
amounted to revenge under grave provocation, suggesting the case should not fall under
the category of "rarest of rare cases."
 Despite the defense's arguments, the High Court upheld the lower court's decision
without alterations and declined to grant a certificate for further appeal to the Supreme
Court.
 This indicates that the High Court found the evidence and legal arguments presented by
the defense to be insufficient to reverse the convictions and sentences of Loki and Ferry.
 Aggrieved by the High Court's decision, Zafer's father approached the Supreme Court of
Insomnia under a Special Leave Petition, seeking further legal recourse.
