Instructions

1. Read these instructions and your chosen question carefully.


2. Choose ONLY 1 (one) question. If you answer all the questions you will get a mark of
zero.
3. Clearly specify the question you are answering at the start of your answer.
4. Word limit is strictly: 1000 words (2 pages excluding cover page and Plagiarism
Declaration). If you exceed word limit, you will be penalized.
5. In all the questions, substantiate your answer using case law, legislation and other relevant
authority.
6. Please use footnotes in the style of the Journal for Juridical Science. Do not use a
Bibliography.
7. All grammatical and spelling errors will be penalized.
8. Use paragraphs – one idea per paragraph and make sure the paragraphs build together into
a coherent argument. If you write one long paragraph you will be heavily penalized.
9. All late submissions regardless of the excuse will penalized 10% for each late day up to a
maximum of 40%.
10. A dropbox will be available under the ‘Assessments’ Tab on Blackboard for you to
submit the assignment together with a Plagiarism Declaration. Please do not email the
assignment as it will not be marked, earning you a zero mark for the assignment.
11. Assignments will be checked for plagiarism. If there is a finding of plagiarism you will get
a mark of zero and disciplinary proceedings according to UFS policy will commence.
12. THE FINAL DAY OF SUBMISSION IS 3 APRIL 2023. This means you can submit your
assignment anytime before that date. There are no valid explanations or excuses for late
submission of an assignment. Hence the penalties. So do not send any emails with accounts
of loadshedding, laptop problems etc.
13. Assignment Rubric – 5 marks for knowledge, 5 marks for structure and grammar and 10
marks for evaluation.

Choose ONLY (1) one question.

1. Discuss the following proposition: “The ‘text-in-context (purposive) approach’ is


unquestionably the preferred and proper approach to legal interpretation in South
Africa.” (20 marks)

2. Discuss the following statement: “Indigenous law plays a prominent role in South
African legal interpretation in South Africa.” (20 marks)

OR

3. Critically discuss whether the South African approach to legal interpretation of


all legal documents is the same. (20 marks)
