AdministrativelawjudgeRobertGiannasifoundthattheemployeesolicitedpolitical contributionsandinvited63people,includingotherNIHemployees,toapoliticalfundraiser atherhomeinBowie,Maryland.TheHatchActprohibitsfederalemployeesfrom knowinglysoliciting,accepting,orreceivingpoliticalcontributions.Becausesheengagedin theseactivitiesinherofficeandusedhergovernmentemailaccount,thejudgealsofound thattheemployeeviolatedtheActsprohibitionsagainstengaginginpoliticalactivitywhile ondutyandinthefederalworkplace.

Emphasizingtheseriousnessoftheemployeesviolations,theadministrativelawjudge statedthattheintentoftheHatchActistoensurethatfederalemployeesmayexercise theirrighttoparticipateortorefrainfromparticipatinginthepoliticalprocessesofthe Nation.Thisrightisinhibitedifotheremployeesinthefederalworkforcesolicitcampaign contributionsthroughtheagencysemailsystemormakepoliticalcontributionsusing governmentcomputerswhileonduty[or]ongovernmentproperty. Inasecondcase,administrativelawjudgeMichaelRosasfoundthatanemployeeofthe NewJerseyDepartmentofChildrenandFamiliesviolatedtheHatchActbyrunningfor RockyHillBoroughCouncilin2008andforNewJerseyGeneralAssemblyin2009.The HatchActprohibitsstateandlocalemployeeswhohavedutiesinconnectionwithfederally financedactivitiesfrombeingcandidatesinpartisanelections.Pursuanttoasettlement, theemployeeagreedtoretirefromhisemploymentwiththeNewJerseyDepartmentof ChildrenandFamiliesasofMay31,2011,andbebarredfromemploymentwithanystate orlocalagencywithintheStateofNewJerseyfor15months. SpecialCounselLernerstated,ThesecasesdemonstrateOSCscommitmenttoprotecting themeritsystemandobtainingdisciplinaryactionforunlawfulpoliticalactivitieswhereitis warranted.
