Q1a) what is the maximum penalty that can be imposed on an occupier for failure to obtain a

certificate of fitness before operating a machine?

ANS; A fine not exceeding fifty thousand ringgit or to imprisonment for a term not exceeding one
year or to both.

b) List three(3) powers of the inspectors


i. To take with him a police officer if he has reasonable cause to expect obstruction in the
execution of his duty.
ii. To require any person who he finds in a factory, office or shop to give such information as it is
in his power to give as to who is the occupier of the factory, office or shop.
iii. To require the production of factory records, certificates, notices and documents kept in
pursuance of this act and to inspect, examine and copy any of them.

Q2. With reference to part II, safety, Health and Welfare, section 25, what are the provisions spelled
out relating to welfare.
i. There shall be provided and maintained for the use of persons employed therein i.e
adequate and suitable accommodation for clothing not worn during working hours.
ii. There shall be provided and maintained at suitable places reasonably accessible to all
persons employed therein i.e an adequate supply of safe and wholesome drinking water.
iii. There shall be provided and maintained so as to be readily accessible a first -aid box or
cupboard of the prescribed standard and when more than one hundred and fifty persons are
employed at any one time a suitable first-aid room of the prescribed standard shall also be
provided and maintained.

ANS: The Department of Occupational Safety and Health ( DOSH) FMA 1967 Act( 139) section 2 & 3

b. List three(3) notifiable occupational diseases spelled out under part IV: Notification of Accident,
Dangerous Occurrence and Dangerous Diseases of the FMA 1967.
i. Pulmonary irritation resulting from inhalation of nitrogen oxides, sulphur oxides, chlorine,
phosgene and ammonia.
ii. Dust diseases of the lungs
iii. Condition resulting from severe heat exposure such as heat cramps or heat stroke.
