Khawaja and others ~-Respondent IVIL MI us RDI ULE ol COUR’ 1980 ON, OF THI QEPAKISTAN Respeefilly sheweth: 1, In pursuance to directions contained in paragraph No, 5 of order dated 28-03-2024 ofthis Court and modification of injunctive order dated 13- 12.2023, the instant application has been filed before this Court. 2. With the modification of injunctive order dated 1312-2023, the Military Courts were allowed to resume trial and therefore handed down sentences in cases of lesser punishments, Moreover, 20 persons were awarded sentences of 1 year. Out of the 20 persons, 17 have served a period of 10-5 months and 3 persons have served a period of 9.5 months. None of the persons have served a full period of one year,= -2L- ‘however, upon confirmation of their sentence, the remaining period of their punishment wos remitted by the Chief of the Army Staff under section 143(1) (i) of the Pakistan Army Act, 1952. |. In furtherance to the above, a list of 20 names of all those persons whose punishment has been remitted and therefore have been released before Eid ul Fitar 2024 is annexed herewith and placed for the perusal ‘of this Court. The said list contains a list of 20 persons that were released in the province of Punjab and Khyber Pakhtunkhwa on 6" and 7% April, 2024 respectively. In view of the request made an behalf of the Federation in paragraph 3 of order dated 28-03-2024 of this Court, the same stands complied with the release of 20 persons before Bid-ul-Fitar 2024.
