works on 21st July 1997 and the following post-tender

6. Letter dated 22nd January 1998 from New Construction

On behalf of the Mental Health Association of Hong
Kong, we are pleased to advise that your tender in the
amount of HK$32,677,269.00(including a contingency sum of
HK$1,000,000.00) has been ccepted. The contract period is
320 calendar days from the Date for possession that will
not be later than 31st March 1998.
Unless and until a formal agreement is prepared and
executed, your submitted tender together with this letter
shall constitute a binding contract between you and the
Employer.
Contract documents are being prepared and you will be
notified when they are ready for execution. All post-tender

correspondence above-mentioned shall form part of the

contract documents.
Please acknowledge your receipt of this letter of
Acceptance by countersigning and returning the duplicate
copy of this letter.

for Good Luck Plaza
Thank you for your letter of 7 May 1999 informing us
of the Employers intention to enter into a contract with
us for this project on the basis of our tender of 5 January
1999.
You request us to start the access to the site in
anticipation of the contract. However, before undertaking
this preparatory work we would like to have an express
undertaking from the Employer to reimburse the cost of any

work so undertaken, together with a reasonable allowance

for overhead and profit, should the contract not proceed
for any reason.
On receipt of this undertaking, we shall proceed
immediately in accordance with your request.
