ORDER: In connection with General Elections to HOP / APLA-2024 necessary arrangements have to be made in advance for smooth conduct of free and fair General Elections regarding to watch on movement of large quantities of cash, illegal liquor or any suspicious item or arms being carried in their area. Accordingly orders were issued vide reference read above by deputing certain officials. Y The SST shall send daily activity report to the Superintendent of Police with a copy to the Returning Officer, Collector & District Election Officer and Observers in prescribed format in Annexure-C on the same day. Y The entire operation by SSTs shall be done in presence of Executive Magistrate and shall be videographed. No such checking shall take place without the presence of Executive Magistrates. ¥ Whenever check posts are put at the borders of the District / State or at any other place by any agency for any purpose, then the nearest SST shall be present therein such team, to avoid duplication of checking the area and reporting has to be done by the SST. ¥ The SST shall put check post at Expenditure Sensitive Pockets/Hamlets Y The SST shall keep watch on movement of illicit liquor, items of bribe or large amount of cash, arms and ammunition and also movement of antisocial elements in their area, The entire process of checking, shall be video graphed. Y The Magistrate in the team shall send Daily Activity Report to the D.E.O. as per proforma in Annexure-C. Y The checking should be video graphed and done in the presence of Executive Magistrate, No checking to be done in the absence of the Executive Magistrate. ¥ The Video record with an identification mark of date, place and team number and it should be deposited with D.E.O. Any member of the public can obtain copy of the video on payment of Rs.300/-. Y Whenever check posts are put at the borders of the District/State or at any other place by any agency, for any purpose, then the nearest SST shallbe present there in such team to avoid duplication of checking in the area and reporting of seizure of cash or items of bribe has to be done by the Sst. Y Checking by SST on the major roads or inertial roads shall commence from the date of Notification of Elections. The SST Controlled by D.E.O. and SP. V During the checking if any cash exceeding Rs.50,000/- noticed in the vehicle of Candidate/his agent or party worker shall be subject to seizure. V Carrying drugs, liquor, arms or gift items which are valued at more than 10,000/- liable for seizure. The event of checking video graphed and copy of the video sent to R.O. ¥ Afany Star Campaigner is carrying upto Rs.1 lakhs, exclusively for his/her personal use or any party functionary is carrying cash with certificate from the treasurer of the party mentioning the amount and its end use, then the authorities in SST shall retain a copy of the certificate and will not seize the cash. V After seizure, the seized amount shall be deposited in such manner as directed by the Court and a copy of the seizure of cash. Y The Maximum Expenditure Limit to the Candidates For Lok Sabha Rs.95,00,000/- For Legislature Rs.40,00,000/- In case of any Grievance about conduct of FST and SST , the Appellate ‘Authority shall be the incharge of Expenditure Monitoring Cell at District Level. INTIMATION TO IT DEPARTMENT: If cash of more than Rs. 10 Lakh is found in a vehicle and there is no suspicion of commission of any crime or linkage to any candidate or agent oF party functionary, then the SST shall not seize the cash, and pass on the information to the Income Tax Authority, for necessary action under Income Tax Laws. APPEAL AUTHORITY ON THE DECISION OF CASH SEIZED CASES: Committee for taking decision on cash seized at District level consists of the following: (i) Project Director, District Rural Development Authority(DRDA), East Godavari District. (i) District Audit Officer, East Godavari District, Rajamahendravaram and Pay & Accounts Officer, East Godavari District (Convener) (ai) District Treasury Officer, East Godavari District, Rajamahendravaram.The procedure of appeal against seizure has to be mentioned in the seizure document and it has to be informed to the aggrieved person at the time of seizure. In no case, the matter relating to cash / seized valuables shalll be kept pending for more than seven days after the date of poll, unless any FIR / Complaint is filed. The functioning of the Committee has to be given wide publicity so that there is no inconvenience to the public. Any other instructions issued by the Chief Electoral Officer / District Election Officer /Joint Collector / Returning Officer / Assistant Returning Officer concerned from time to time should be followed scrupulously. The officers mentioned above are hereby directed to report before the Returning Officer / Assistant Returning Officer of the concerned Assembly Constituency.
