TWO YEARS DEGREE COURSE, 2020-21 ANDg © |2 ONWARDS (BASED ON CBCS SYSTEM) WHEREAS, it is necessary to reorient legal education by making provision for instructions in new courses of study, extensive as well as intensive and integrated study of prescribed courses, and for adequate practical training for diverse careers open to law Post-graduates. AND WHEREAS, with a view to reorient legal education as aforesaid and to provide sufficient opportunity for adequate instruction as well as training in law, the University of Lucknow has instituted a LL.M. Two year course study and has approved of a syllabus of studies there for: NOW, THEREFORE, the University of Lucknow frames these ORDINANCES for the implementation ofthe aforesaid policy decisions: 1, The Degree of LL.M. Two Year Course ‘The University of Lucknow may confer the Degree of Master of Laws LL.M. Two Year Course fon such candidates who, being eligible for admission to the LL.M, Two Year Course have received regular instructions in the prescribed courses of study undergone required practical training, passed relevant examination and, being otherwise suitable by virtue of their character: have fulfilled such other conditions as may be laid down from time to time. 2. Eligibility for Candidate: A candidate will be eligible for admission to LL.M. Two Year Course if he/she has completed Law Graduation from UGC recognized University and has secured not less than 50% marks at Graduation for General and OBC. However, for SC/ST candidate minimum percentage of marks will be 48%. 3._Age Restriction ‘The age requirement of the candidate must be according to guidelines of BCI and Supreme Court of India. 4. Seats ‘There shall be 60 seats 5. Admission Procedure: Admission to the LL.B. Three Year Course will be strictly on the basis of merit prepared according to percentage of marks obtained in the entrance examination conducted by University of Lucknow or as per the Lucknow University Admission Committee decision provided that weightage and reservations shall be given as permissible under University Rules. 6. Curriculum and course Structure Page|3 Introduction to CBCS System : 1a) The CBCS provides an opportunity for the students to choose courses from the prescribed courses comprising Generic Core, Elective Groups (FIVE fixed specialisation) and Choice Based Disciplinary Courses (CBDC), Choice Based Interdisciplinary Courses (CBIC) and Half Credit/Minor Courses /MOOCS/ Value Added Courses. The courses can be evaluated following, the grading system. Grading system provides uniformity in the evaluation and computation of Cumulative Grade Point Average (CGPA) based on student's performance in examinations which ‘enables the student to move across institutions of higher learning. The uniformity in evaluation system also enable the potential employers in assessing the performance of the candidates. b) Programme Objectives (POs): ‘The LL.M. Programme is aimed at: = Fai rising students with laws and judicial interpretations at the national and international level and provide a comparative study of the contemporary and tradi nal laws and judicial interpretations. *Apprising students of the legal system, rule of law, and administration of justice, while promoting specialised branch of study and research in diverse fields oflaw * Imparting interdisciplinary approaches to law and legal development by involving philosophy, economics and scientific approach towards law study and research. = Imparting professionally and socially relevant legal education. = Sensitising students towards the issues of access to justice of the deprived, marginalised and weaker sections of society. Producing intemnationally competent litigating lawyers, corporate lawyers, judges, judicial officers, legal officers, researchers, law reformers, law teachers, ete, = Imparting skills of legal reasoning, problem solving, research, legal writing, oral and written communication, persuasion, leadership and teamwork. Promoting ethical practices in the profession of law. * Promoting inter-disciplinary approach to legal profession. c. Programme Specific Outcomes (PSOs): At the end of the LL.M. course, the students will be able to: Study and explore law in an interdisciplinary and comparative manner. Evaluate and compare domestic and international laws. Design, and formulate case theory and strategy. Programme is a two years course divided into four semesters. A student has to complete 96 credits for the completion of the course and award of the degree. Assessment of Students’ Performance and Scheme of Examination Pass Percentage & Promotional Criteria : 1. English shall be the medium of instruction and examination. 2. Assessment of students’ performance shall consist of: 70 marks (End Semester Written Examination) and 30 marks (Internal Assessment). 3. The duration of the End Semester Written Examination in Core Courses and Elective Courses shall be three hours for 70 marks. 4, For internal assessment of 30 marks, one internal Test+AssignmentPresentation/Viva shall be in the class in each course in each term. 5. Internal Assessment Rules In every compulsory paper there shall be an internal assessment and End Semester Examination divided in 30% & 70%. The Internal Assessment shall be of 30 marks having following components: a) Written test 15 marks b) Assignment +Presentation 10 marks ) Attendance 05 marks In the end of semester, an end term examination of 70 marks covering the full syllabus of paper concerned shall be conducted. The examination including Back paper/Exempted etc., of the LL.M. shall be as per the extent rule of the Examination of the University of Lucknow. TWO YEARS DEGREE COURSE TO BE EFFECTIVE FROM ACADEMIC SESSION-2020-21 EXAMINATION ‘* In every Individual paper, excluding value added (non-credit) paper there shall be an Internal Assessment and End Semester Examination divided into 30 % Internal + 70 % Theory. * The candidate has to obtain 40% of the total marks in individual paper. However, 40% of the marks of theory paper are mandatory to pass in individual paper. For example, if theory paper is of 70 marks he/she must obtain 28 marks in that individual paper. PASS ‘© Ifthe candidate secures 40% of the marks in individual papers and 50% of the total marks of the semester, he/she shall be treated as pass. DIVISION © Ifthe candidate secure 50% or above but less than 60% of the total marks he/she shall be given Second Division, ‘+ Ifthe candidate secure 60% or above of the total marks he/she shall be given First Division. FAIL * If the candidate could not 40% marks in more than three individual papers of a given semester, shall be considered as Fail. BACK PAPER ‘+ A candidate will be allowed to appear in Back Paper examination in maximum three Papers of a semester of the course in which he/she has not obtained 40% marks in individual papers provided has obtain minimum of 40% marks in aggregate of total marks. However, total number of back papers to be allowed to appear including even and odd semesters shall be six. It means if 2 candidate has more than six papers as back paper including odd and even semester he/she shall not be promoted to next semester. EXPLANATION © Ifa candidate secured 40% marks in individual paper and has also secured 40% in ageregate. He/she can be appear in concerned semester back paper examination with maximum of three papers.
