Implementation of the transmission projects are invariably getting affected due to severe ROW problem on account of resistance by the landowners/farmers, who are demanding enhanced compensation, In order to streamline, the process of ROW assessment and compensation issues and to formulate the uniform approach for all our projects, management constituted a committee of senior officials to look into the aspects and suggest possible solutions. The committee has submitted its recommendation and based on approved recommendations, detailed guidelines for ROW process and compensation has been drawn and same is enclosed for implementation with immediate effect. Survey 1.1.Land Scheduling including details of ownership, Rights, Tenancy and Crop (RTC) details along with maps are to be included as part of detail survey. 1.2.To optimize time such survey may be allowed as a parallel activity in portion/ section along with construction activity. 1.3.The data of survey including details of ownership shall be verified by POWERGRID in consultation with local revenue authorities before release of payment. 2. Damaged Area Assessment 2.4. Tower Bass i, The area damaged during the process of foundation, erection and stringing to be recorded along with tree and crop description. ji, The maximum area for all three activities in respect of 400 KV & 765 KV DIC line have been finalized and is enclosed as Annexure-I. il, The said area shall be treated as maximum limit for caloulation of tree/crop damage. In case the damaged area crosses the stipulated limit, approval of GM/ AGM for additional area shall be required with juslification for release of compensation 2.2. Line Corridor: i. Cost of Land 3.1 For compensation towards land cost and diminishing land value (85% for tower base & 15% max. for corridor), rate of land compensation, shall be obtained from concerned DM/DC/ Revenue Authorities in line with provisions of MoP guidelines. 4. Compensation for structure / Bore well | Hutments 4.1 Compensation towards such structure shall be restricted in the area falling under the conductor to conductor width plus 3 meter on each side. 4.2 CEA safety regulation of September 2010 shall be used as a basis of calculation for any other structure requiring removal! shifting. 3.4 Legal notice is to be issued to the owners of such structures, where actual shifting/removal has not taken place in spite of payment of compensation before commissioning, 5. Compensation for Fruit/Non Fruit Bearing Trees 5.1 In-Principle approval of Regional Head, once, for total estimate of tree compensation in one go or section wise is mandatory. 5.2 Supreme Court directives ie maximum 08 years for fruit bearing trees be followed in cases where no specific state regulation exist. 5.3 For felling/compensation of trees in the Orchard or Plantation documentation annexed with visual proof like GPS tagged photos / videos etc. are must for assessment! release of compensation 5.4 Separate approval of Regional Head is must for release of compensation beyond Rs 10 Lakhs per person. = ‘ 5.5 Required clearances/permission for felling of trees including "Excise trees” shall be obtained from concerned authorities. Control and Reconciliation of Notices 6.1 All control/ protocol like Printing, Numbering, and Regulation for its issuance use etc. applicable to measurement book (MB) shalll also apply to notice books henceforth. 6.2 All notices for tree crop compensation shall be countersigned by the executive/ office in-charge before issuance to affected person with proper documentation. 7. Verification by Revenue Authorities. A. Ownership: land ownership certification by the revenue officials at least by Patwari or equivalent (Custodian of land record). B. Compensation: 7 Verification of revenue officials as per DOP clause 25 (C) for release of compensation in normal cases. 7.2 In exceptional cases, where inordinate delay is encountered in obtaining such Verification from revenue authorities in spite of documented concerted efforts, verification may be approved by a project level committee of Sr. officials constituted with approval of Regional Head based on rates obtained/ recommended by officials of revenue / Horticulture/Forest departments of concerned State, 8. Authority for approving orders of local authorities 8.1 Following procedure shall be followed for orders of local revenue authorities regarding compensation beyond the prevailing norms. Payment of Compensation 40.1 All compensation payment shail be made through online transfer. 10.2 Crop compensation to actual cultivator (other than owner) with the approval of Regional head can also be released after verification of tenancy’ by’ Local Panchayat!
