WRIT PETITION No.41981 of 2015

ORDER: (Per the Hon’ble Sri Justice Abhinand Kumar Shavili)

The writ petition is filed seeking the following relief:

“…to issue an order or direction more particularly in the nature of

Writ of Certiorari calling for the records pertaining to order dated
24.11.2014 in O.A. No. 1259 of 2012 of the Central
Administrative Tribunal, Hyderabad Bench, Hyderabad and
quash the same as illegal, arbitrary, contrary to law and pass
such other orders…”

2. When the matter is taken up for hearing, learned Deputy

Solicitor General of India, appearing for the petitioners had

informed the Court that during pendency of the Writ Petition,

the case of the respondents was considered for promotion.

However, some of the respondents have not accepted the

promotion, some of the respondents have expired and some of

the respondents have retired from service.

3. Having considered the said submissions, this Court is of

the view that the Tribunal, vide order, dated 24.11.2014, has

directed the petitioners to give promotion to the respondents.

The learned Deputy Solicitor General of India, appearing for the

petitioners has informed this Court that they have promoted

some of the respondents, some of the respondents have not

accepted the promotion, some of the respondents have expired

and some of the respondents have retired from service, which

indicates that the petitioners have complied with the order

passed by the Tribunal. Therefore, this Court is not inclined to

interfere with the impugned order dated 24.11.2014, passed by

the Tribunal at this point of time.

4. Accordingly, the Writ Petition is dismissed. No costs

As a sequel, miscellaneous applications pending, if any,

shall stand closed.
