ORDER BELOW EXH. 4 IN


CRIMINAL BAIL APPLICATION NO. 714/2023

1] Ld. Advocate for the applicant has argued that, applicant is 74 years old
mother­in­law. The allegations against her are she supported to accused and abused
the prosecutrix. Ld. Advocate has argued that, she is resident of Aurangabad and
having permanent address. Considering allegations against her custody is not
necessary. Since FIR is registered there is apprehension of arrest. She is ready to
furnish surety and abide by terms and conditions. Hence, ad­interim protection be
granted.

2] On perusal of FIR Prima Facie it is seen that, main allegations are


against the co­accused. The allegations against present applicant she abused and
supported co­accused. Applicant is 74 years old. Considering allegations against her
custodial interrogation does not seem necessary. It is proper to grant ad­interim
protection on stringent conditions. Hence, proceed to pass following order.
ORDER
1. Application Exh. 4 is allowed.
2. Applicant Ashalata Vaijinath Misal is granted ad­interim anticipatory bail
during the pendency of the hearing and final disposal of the main application
in the event of arrest in connection with C. R. No. 1633/2022, under Sections
498­A,377,323,504,506 read with Sections 34 of the IPC of Hadapsar Police
Station and she be released on execution of P.B. and S.B. in the sum of
Rs.30,000/­ with one surety of the like amount.
3. The applicant shall not, directly or indirectly, make an inducement, threat or
promise to any persons acquainted with the facts of the accusation against
her so as to dissuade her from disclosing such facts to the Court or to any
police officer.
4. The applicant shall not leave India without prior permission of the
Investigating officer in writing.
5. The applicant shall co­operate the Investigating Officer during

investigation and attend police station whenever required by the I.O. till filing
of charge­sheet.
6. The applicant shall at the time of execution of the bond, furnish her address
and mobile number to the Investigating officer, and shall inform the change
in residence if any.
7. If breach of any of the above conditions is committed, the order of bail shall
stand cancelled.
8. Issue notice to the learned Public Prosecutor and Investigating Officer
returnable on 13/02/2023.
9. Copy of this order be served upon the Public Prosecutor and Commissioner of
police.
