In such an event, the engagement for service will be terminated without any compensation and you will not be entitled to any payment for the period of absence, Your remuneration starts only upon insurance of the AEP by the authorities and your commencement of work at your allotted station/department.Furthur more, if at any time, for any reason, your AEP is revoked, the Company may terminate you without notice. In case your place of work is the operational area for which ABP is requirement to perform your duties, your employment and remuneration will commence after you attained an AEP and rostered for work in your allotted department. In other case you employment and remuneration will commence from the date you have joined duties. 2. Probation & Confirmation ‘You will be placed on probation on your joining the company, The probation period will be 6 months. You may confirmed prior to 12 months depends on your performance or your probation period may be extended if so deemed necessary by the company for such further period as it deems fit. After completion of probation period, either initial or extended as the case may be, the Company ‘may at its own discretion confirm your engagement with the Company for the period of 3 years inclusive of probation. If the probationary period is not extended or confirmed in writing, your services will be terminated by the Company. Security Deposit: ‘You will be required to deposit with the company an amount towards the cost of training and uniform incurred on you by the Company and experience gained in the Company in the course of employment You will be required to undergo several trainings as required for your job role during the start of your employment. In the event, if you abscond soon after the training, you will be required to pay 90 days gross salary in lieu thereof to cover the investment that have been made on you, in the event you refuse to pay, company will view this as an act of gross miss conduct and take disciplinary action, including legal to cover the investments that have been made on you. In case of loss /damage of uniform, you will be required to pay the cost of the additional uniform, You will be entitled for the medical benefits as per the Employees’ State Insurance Act 1948(“ESIC ACT") For those employees who come under the purview of the Act, the Company ensure them for an amount of Rs.2, 00,000/- towards hospitalization, 8. Location: ‘You will be initially posted at Delhi or Hyderabad, but you can be transferred to any other ‘group/Company/affiliate/sister concern/subsidiary of the company anywhere in India. You base location will be at the absolute discretion of the company. 9, Personal Particulars:- You shall keep the company informed in writing of any change of your marital status and residential address, any communication sent to you at the address available with the Company shall be deemed to have been served on you. If you are required to work in Airport Premises, you will also be issued an Airport Entry Pass (AEP) at the time of being engaged, which is to be displayed all the times in the Company and Air port premises. Loss of Identity card must be reported immediately to HRD, duplicate will be issued with the charges of Rs 150/- in case of AEP you have to follow the rules laid by BCAS. 11, Accommodation: ‘You will not be provided any accommodation by the company. 12, Transportation:- Transportation if considered by the company at any time/ any reason whatsoever shall be at the discretion of the management 13. Working Hours:- ‘Your working hours may be 48 hours per week (whether on shift or otherwise) excluding, break periods and shall also be subject to change without any notice. You may be required to work for additional hours in exigencies, for which you will be compensated as per Company’s policy. You shall be at work at the establishment at the times fixed notified. If you attend late or after recording attendance are found absent from your work place during working hours without permission or without sufficient reason, you shall be liable disciplinary action as deemed fit. Salary and wages will be paid as far the time recorded in the system such as biometric aitendance. No type of leave can be availed of as a matter of right. The authority empowered fo grant leave has the discretion to refuse or revoke leave granted due to exigencies of the Company's, work Leaves can be granted as per the policy if Company. A) Declared Public Holiday ;- You will be eligible for 10 days declared holidays in a Calendar year. b) Casual Leave(CL):- You will be eligible for casual leaves to the extent of 7 days ina financial year. ) Sick Leave: You will be eligible for casual leave of 7days ina financial year. Sick leave of more than | days availed has to be supported by Medical Certificate. d) Privilege Leave (PL):- You will be eligible for 21 days privilege leave in a financial year on prorate basis, you need to inform one week before in advance if you are applying for more than 2or 3 days to the concerned person/department in case of emergency, 16. In the event of your involvement in any kind of acts which is detrimental to the interest of the Company like Police case/Customs or any other government authorities ,for your involvement in any criminal activity, your engagement with the company will be terminated immediately. In case your contract is not renewed, your employment with the company automatically lapses and your services stand terminated without any kind of compensation by Company. 17. Notice Perio An employee on probation may leave or be discharged from service with a notice of 30 days In case you wish to leave your contractual engagement at any time with in the 3 years period of engagement, you shall be required to give 90 days’ notice in writing and serve the notice period until last working day, Breach of any of the above conditions will render you liable to termination without notice and compensation. 18, Separation: Should you leave organization without giving the requisite notice period, no dues will be payable, including full and final settlement AEP surrender copy and relieving experience certificate. On termination of your engagement /resignation you immediately have to return all the company assets to the concern department (Id card, AEP, uniform, cell phone and documents etc) and obtain clearance in the clearance certificate from the relevant officials/department. 19. You shall only be entitled for the benefits and Emoluments as offered herein above and accepted by you irrespective of your place of posting uring your engagement period, This letter of engagement if not extended or terminated earlier will automatically expire at the end of the period as mentioned above without the company having to do any other action in this respect. 20. Confidentiality:- ‘You shall undertake to maintain strictest secrecy concerning the activity of the company. You shall not publish or cause to be publishing any article, book, photograph, letter or give any interview or broadcast or deliver any lecture or speech on any matters which concerns your Guties or business of the Company without prior permission from the company obtained in writing. ‘Your knowledge that you may, during the term of your employment with the company, have access to and become familiar with various trade secrets and confidential or business information of the company and its operations property, processes, finances and business affairs, Therefore you shall not, during or after term of engagement with the company disclose to ant third party any such trade secret or confidential business information directly or indirectly or modify or use them in any way for your own purpose or for any purpose other than those of the company in the course of performing your duties. ‘You shall not copy ,extract or translate, remove or delete any documents or paper containing or relating to such trade secrets or confidential or business information's except as authorized or required by your duties as an employee of the company. ‘The confidentially clause 21(a) and 21 (b) shall come into effect from the date of signing letter and provision of the clauses shall survive the termination of this contract. If there is any breach in terms with regard to confidentially, the company shall have the right to terminate your ‘engagement at any time in writing without notice and shall be entitled to damages. In addition of the provision of this clause, your confidentiality obligations to the company shall be governed by the terms and conditions of the individually Non-disclosure Agreement, attached hereto as Annexure B ,which shall be considered as a integral part of this letter of engagement. Jurisdictio: This agreement be governed by the laws of India and the courts of Mumbai, India shall have exclusive jurisdiction to try all disputes between the parties pursuant to this agreement. 23.
