ARTICLE 315, RPC - Swindling or Estafa - shall be punished as follows

 If the amount of the fraud does not exceed ₱40,000, the penalty of arresto
mayor in its medium and maximum periods shall be imposed. (2 months and 1 day
to 6 months)
 If the amount of the fraud is over ₱40,000 but does not exceed ₱1,200,000, the
penalty of arresto mayor in its maximum period to prisión correccional in its
minimum period shall be imposed. (4 months and 1 day to 2 years and 4 months)
 If the amount of the fraud is over ₱1,200,000 but does not exceed ₱2,400,000,
the penalty of prisión correccional in its minimum and medium periods shall be
imposed. (6 months and 1 day to 4 years and 2 months)
 If the amount of the fraud is over ₱2,400,000 but does not exceed ₱4,400,000,
the penalty of prisión correccional in its maximum period to prisión mayor in
its minimum period shall be imposed. (4 years, 2 months, and 1 day to 8 years)
 If the amount of the fraud exceeds ₱4,400,000, the penalty of prisión mayor in
its minimum period shall be imposed, adding one year for each additional
₱2,000,000; but the total penalty which may be imposed shall not exceed twenty
years. (6 years and 1 day to 8 years)

However, any person who shall defraud another by means of false pretenses or
fraudulent acts under Article 315 paragraph 2(d) of the RPC, to wit: This type
of Estafa shall be punished by:
 If the amount of the fraud does not exceed ₱40,000, the penalty of prisión
mayor in its minimum period shall be imposed. (6 years and 1 day to 8 years)
 If the amount of the fraud is over ₱40,000 but does not exceed ₱1,200,000, the
penalty of prisión mayor in its medium period shall be imposed. (8 years and 1
day to 10 years)
 If the amount of the fraud is over ₱1,200,000 but does not exceed ₱2,400,000,
the penalty of prisión mayor in its maximum period shall be imposed.(10 years
and 1 day to 12 years)
 If the amount of the fraud is over ₱2,400,000 but does not exceed ₱4,400,000,
the penalty of reclusion temporal in its minimum and medium periods shall be
imposed. (12 years and 1 day to 17 years and 4 months)
 If the amount of fraud is over ₱4,400,000 but does not exceed ₱8,800,000, the
penalty of reclusion temporal in its maximum period shall be imposed. (17 years
and 4 months and 1 day to 20 years)
 If the amount exceeds ₱8,800,000, the penalty shall be reclusion perpetua.

SEC. 4 (a)1, RA 10175 (ILLEGAL ACCESS), SEC.4(a)3,RA 10175 (DATA INTERFERENCE),

and SEC. 4 (a) 4, RA 10175 (DATA INTERFERENCE),
Person found guilty of any of the punishable acts enumerated in Sections 4(a)
and 4(b) shall be punished with imprisonment of prision mayor or a fine of at
least PhP200,000.00 up to a maximum amount commensurate to the damage incurred or
both.
 If punishable acts in Section 4(a) are committed against critical
infrastructure, the penalty of reclusion temporal or a fine of at least
PhP500,000.00 up to maximum amount commensurate to the damage incurred or both,
shall be imposed.

SEC. 4 (b) 3, RA 10175 (COMPUTER RELATED IDENTITY THEFT)

 4(b) of this Act shall be punished with imprisonment of prision mayor or a fine
of at least PhP200,000.00 up to a maximum amount commensurate to the damage
incurred or both.
 if no damage has yet been caused, the penalty imposable shall be one (1) degree
lower.

SEC. 4 (c) 4, RA 10175 (ONLINE LIBEL)

 Penalty under sec. 4 of RA 10175 is prision correccional in its minimum and
medium periods (i.e., 6 months and 1 day to 4 years and 2 months).

REPUBLIC ACT 8484 (ACCESS DEVICE ACT)

Person committing acts constituting access device fraud shall be punished with:
 (a)a fine of P10,000.00 or twice the value obtained by the offense, whichever
is greater and imprisonment for not less 6 years and not more than 10 years, in
the case of an offense under Section 9 (b)-(e), and (g)-(p) which does not
occur after a conviction for another offense under Section 9;
 (b) a fine of P10,000.00 or twice the value obtained by the offense, and
imprisonment for not less than 10 years and for not more than 12 years, in the
case of an offense under Section 9 (a), and (f) of the foregoing section, which
does not occur after a conviction for another offense under Section 9; and

 (c) a fine of P10,000.00 or twice the value obtained by the offense, or

imprisonment for not less than 12 years and not more than 20 years, or both, in
the case of any offense under Section 9, which occurs after a conviction for
another offense under said subsection, or an attempt to commit the same.

ARTICLE 282 of the RPC (THREAT) in relation TO SEC. 6 of RA 10175

Grave threats. – Any person who shall threaten another with the infliction
upon the person, honor or property of the latter or of his family of any wrong
amounting to a crime, shall suffer:
 If the offender shall not have attained his purpose, the penalty lower by two
(2) degrees shall be imposed.
 If the threat be made in writing or through a middleman, the penalty shall be
imposed in its maximum period.
 The penalty of arresto mayor and a fine not exceeding ₱100,000, if the threat
shall not have been made subject to a condition. (As amended by R.A. 10951)
 All crimes defined and penalized by the Revised Penal Code, as amended, and
special laws, if committed by, through and with the use of information and
communications technologies shall be covered by the relevant provisions of this
Act: Provided, That the penalty to be imposed shall be one (1) degree higher
than that provided for by the Revised Penal Code, as amended, and special laws,
as the case may be.

REPUBLIC ACT 9995 (ANTI PHOTO and VIDEO VOYEURISM)

 Violation of RA 9995 is punishable by imprisonment and/or a fine. Violation of
RA 9995 is punishable by imprisonment of not less than 3 years but not more
than 7 years and/or a fine of not less than P100,000.00 but not more than
P500,000.00.
ARTICLE 287 of the RPC (UNJUST VEXATION)in relation to SEC. 6 of RA 10175
 Violation of Article 287 has a penalty of arresto mayor in its minimum period
(one month and one day to six months) or a fine ranging from Php500 to
Php5,000.00, or both.
