TUTORIAL TOPIC 1

1. Define law and aim of law

Law defines as body of rules which enforced by state.

Aim of law attain justice in society. Justice is an abstract idea of right and wrong, fairness and
equality.

2. Define state

Legal system administered almost entirely based on the political unit.

3. List THEREE (3) classification of law.

a. Public Law

b. International Law

c. Private Law

4. Define trust

Trust – equitable obligation binding a person (trustee) to deal with property over which he
has control (trust property) for benefit of persons (beneficiaries).

5. List any FOUR (4) sources of law

a. Written Law - Federal Constitution, State Constitution

b. Unwritten Law – English Law, Judicial decision

6. Explain on 1st Class Magistrate Court

a. The amount of subject matter does not exceed RM 25,000.00

b. When found guilty, magistrate may pass any sentence allowed by law not exceeding.

 5 years imprisonment

 Whipping of up to 12 strokes
 Combination of above mentioned

7. List the Superior court in Malaysia

a. The High Court

b. The Court of Appeal

c. The Federal Court

8. Explain any TWO (2) jurisdictions of High Court

a. Appellate – Hear civil and criminal appeals from Magistrates’ and Sessions Courts

b. Supervisory – Conferred general supervisory and revisionary jurisdiction over all


subordinate courts

9. Explain of Syariah Court

Enforce Islamic law in Malaysia, comprises the Court of the Chief Kadis. Islamic rules as
evidence and jurisdiction between parties who are Muslims.

10. Explain Juvenile Court

Deal with criminal offenders below 18 years old and the court consist of first class magistrate
and 2 lay advisor, one whom shall if practicable be a women. The function of advisor to
advice court with respect any consideration affecting punishment.
