Firstly – That you, on the 5th day of July, 2023 at Dhinloya, committed dacoity, and thereby
committed an offence punishable under section 395 of the Indian Penal Code, and well within
the cognizance of the Court of Sessions.

Secondly – That further, on the 4th day of July, 2023, at Dhinloya, assembled together with 4
others, having made preparation for committing such dacoity, and thereby committed an
offence punishable under section 402 of the Indian Penal Code, and well within the cognizance
of the Court of Sessions.

Thirdly – That you, conspired jointly with 4 others and intentionally aided towards the
commission of the offence of dacoity, and thereby committed an offence punishable under
section 120-B of the Indian Penal Code, and within the cognizance of the Court of Sessions.

Fourthly – That you, committed the offence of wrongful restraint against the complainant and
thereby committed an offence punishable under section 341 of the Indian Penal Code, and
within the cognizance of the Court of Sessions.

Fifthly – That you, committed the offence of voluntarily causing hurt for the purpose of
extorting property and thereby committed an offence punishable under section 327 of the
Indian Penal Code, and within the cognizance of the Court of Sessions.

That an FIR bearing no. 184/23 was registered by the complainant at Police Station Block-D,
Dhinloya on 05.07.2023 at about 14:15 PM, via a complaint given in writing, which read as
follows:

“To the SHO, Police Station Block-D, Dhinloya. Sir, please kindly take note of the crime that
has been committed upon me and my brother, Paramjeet Singh. Both of us are sons of Sh.
Khadak Singh, and live separately in Dhinloya. I am a resident of Kothi No 65, Purav Marg,

Chowpatty Nagar, opposite Mannat, Dhinloya- 420065, while my brother is a resident of


Bungalow No 111, Dakshin Marg, Vidya Nagar, opposite Galaxy Apartments, Dhinloya-
420003. That a grave crime has been committed upon me and my brother during the late night
of 04.07.2023 and early morning of 05.07.2023, by several persons, completely unknown to
me. My son has his birthday on the 05th of July, and so, to celebrate his birthday, a grand late-
night party was organized at the intervening midnight of 04-05 July, 2023, by my wife, Smt.
Preeti Singh and me at our farmhouse at Dhinloya, Villa No. 786, Central Park Colony,
Dhinloya-420001. The party was a big gathering of friends, dear relatives and colleagues of both
my wife and myself. We decided to hire professional catering services and the catering services
of M/s Ambro Pvt Ltd were hired by us for food and other services. During the party, after the
cake-cutting ceremony at about 12:00 a.m., I went into my room to place the several shaguns
and gifts given to my son on his birthday to keep them safe. Unknown to me, three persons
from the catering company followed me into the room. Before I could react, one of them closed
the door from behind and the other placed an iPad in front of me. I could see my brother visibly
terrified, being tied to the chair and his mouth taped. I could hear a person threatening him from
behind the camera, restraining his movement. Then I was told by the person standing beside me
that my brother would be harmed if I did not give them ₹1.5 crore immediately. At first, I
showed some resistance to which they got very angry and resultantly warned me of what would
happen if I tried to act smart. I was terrified, and fearing for the life and safety of my brother,
I immediately agreed to do whatever the people in my room asked me to do. I told them that I
did not have a lot of cash with me as this was my farmhouse and not my actual house. At this,
they started getting angry and told the same to the person in the video call. The person then
pushed my brother to the ground, and warned me again, of what would happen if I tried to act
clever. At this point, I was too scared to think clearly and hence, in my fear, told them that I had
some cash in my safe and I could give them the same. Hearing this, the persons in the room
calmed down a bit, decided to talk among themselves and within a few minutes asked me how
much cash I had. I replied that I had around 50-60 lakhs to which they hesitantly agreed. I went
and opened my safe placed in the study itself and gave them the same. The moment I handed
over the cash, I saw in the video that the person pushed my brother and she got outside the
frame of the video. After which they disconnected the call and the persons asked me to go
inside the washroom and come out only after 5 minutes. After five minutes, I came out and
decided to go out to my wife and child, to not cause any panic. The persons had threatened that
they would be observing me, and if I tried to alert anyone, it would not be good for me or my

near and dear ones. Hence, I acted as if nothing had happened. I request you to take action
against the persons involved.

Acting upon the complaint received, two teams were sent to the place of occurrence, one to
Villa No 786, Central Park Colony, Dhinloya-420001, farmhouse of the complainant, Mr. Kabir
Singh, and another team was sent to Bungalow No 111, Dakshin Marg, Vidya Nagar, opposite
Galaxy Apartments, Dhinloya- 420003, residence of the brother of the complainant, both under
the supervision of Investigating Officer ASI Amit Sharma. Nothing was recovered from the
house of the brother. From the farmhouse of the complainant, CCTV footage, wallet,
smartwatch and smartphone of the complainant were recovered as pieces of evidence. Based
upon the CCTV footage and the statement of the complainant, the arrest of the three persons
suspected to be in the room where the offence was committed, namely Vijay Gupta, Deepak
Rajhans and Raj Malhotra were carried out, on 06.07.2023. A search of the residences of the
above three accused was carried out under 165 Cr.P.C. During the course of the investigation,
statements of the three accused were recorded by the police. While investigating accused no. 1
Vijay Gupta, the name of an online game, Ninecraft came to the forefront. The police filtered
through the servers of Ninecraft, a virtual reality game, through the confiscated laptops of the
three accused wherein a common server was found, which had among others, the three accused
as its members. An investigation was made into the profile of the other members of the server,
and according to the investigation, there was a reasonable suspicion of the involvement of two
other members namely Rani Oberoi and Gourav Sharma. Rani Oberoi was arrested on
11.07.2023 and Gourav Sharma is still absconding. A search of the residential premises was
carried out by the police of the other two accused persons under section 165 Cr.P.C. A few
relevant news articles were found of the accused No. 5 Rani Oberoi, which have been attached
herewith.

STATEMENT OF PROSECUTION WITNESSES

Kabir Singh (Complainant)

Under Section 161, CrPC

On the occasion of my son’s birthday, I arranged a midnight party at my house on 4th July, all
my friends, family and business associates were invited. Due to the size of the guest list and my
social stature, my wife and I decided to hire a high-end catering company for the party. We
finalized the name of two companies, M/s Eat-it-all Pvt Ltd and M/s Ambro Pvt. Ltd. Although
the package of the former company was more financially beneficial to us, we decided to go with
M/s Ambro Pvt. Ltd., as we had heard very good words, and also because of the suggestion of
a close friend. Hence, we approached M/s Ambro Pvt. Ltd. for their services.

On the day of the party, after the cake cutting, I went to my room to keep all the cash and gifts
received. Upon reaching the room, while I was bolting the door, 3 persons from the catering
staff out of nowhere pushed me into my room and closed the door. When I tried to confront
them, they threatened me. To my utter surprise, my brother was on a live video call being held
as a hostage by a person standing behind the camera. Threatening me with my brother’s safety,
they demanded cash from me. When I denied the availability of cash with me, the person on the
call pushed my brother to the ground. Fearing for the life of my brother, I gave them all the cash
that I had.

They then asked me to go to the washroom and come out only after 5 minutes, threatening me
with grave consequences against my brother and my son if I tried to come out earlier or to give
a clue to someone. After five minutes, I went back to the party and acted normal so as not to
raise suspicion in fear of the life of my family.

Paramjeet Singh (Brother of the Complainant)

At around 11.40 pm on 04.07.2023, I returned from my office at my residence Bungalow No


111, Dakshin Marg, Vidya Nagar, opposite Galaxy Apartments, Dhinloya- 420003. I checked
with the security and went to my room to use the washroom. Everything was fine till then, my
wife was not at home that day, as she was out of town. When I came out of the washroom, I
could see that the security person was not active in his seat, I thought he dozed off, I called him
but the security guard didn’t pick up the call. Until I could go downstairs, I sensed someone was
coming upstairs, it took me 2 minutes to figure out until then one masked woman rushed into
my room and instructed me not to move. She threatened and I was under the fear and followed
all the directions given by her. She made me sit down on a chair and then tied me with rope and
taped my mouth. All of this happened so quickly that I couldn’t comprehend what was
happening. She didn’t say anything, neither did she ask me anything, we were at the same place
in the same situation for 10 mins. After a few minutes, she received a call, it was a video call,
and to my utter surprise, I saw my brother, Kabir Singh on the call. He was with a person who
was telling him to transfer some money in lieu of my safety. My brother looked scared, worried
and under fear and tension. After a lot of discussion between them, my brother gave them a bag
full of cash. I couldn’t hear anything as they had muted the call. As soon as the purpose was
fulfilled, I was pushed away and the call was disconnected. The woman left my house
immediately and I had to stay tied till next 1-1.5 hours, only when I could get myself out of it. I
was extremely frightened and couldn’t think of anything, I went down and checked with the
security, he was under the influence of something and was unconscious.

Gopinath Kumar (Servant at the house of the Complainant)

My name is Gopinath Kumar and I am 60 years old. I am a servant at the house of Kabir Sir. I
have been working at his house for the last 27 years. I was present at the house and assisted
Memsaab in some household chores on the day of Chote Sahab Ji’s birthday in the evening.

On that day, I noticed something strange about Kabir Sir’s behaviour. When the party was
about to get over and I was passing by the room of Kabir Sir, I heard him shouting. After some
time, I heard the voices of some other persons as well. When I got suspicious, I went near the
door to his room.

There, I saw him fighting with some persons, who I believe were the waiters and the organiser
of the party. Kabir saab was sweating profusely and was also short of breath, as if he had been
put through a lot of stress. After their argument, I saw that Kabir Sir gave a bag to those people
and the people left.

Anil Singhvi (Managing Director, Singhvi Pharma Pvt Ltd)

Under Section 161, CrPC

I am Anil Singhvi, Managing Director of Singhvi Pharma Pvt. Ltd., and I was invited to a party
hosted by my friend, Kabir Singh, who is a close friend, and an old business partner of mine.
The party took place at his farmhouse. On the late evening of 04.07.2023, during the party, I
observed a group of individuals who appeared to be dressed as waiters. They were a part of the
catering staff and they were hurriedly taking Kabir into the bedroom of his farmhouse. I noticed
that Kabir seemed distressed and was being led into the room against his will. He was a bit
uncomfortable, and it was evident that he did not go willingly with them. Their actions appeared
suspicious, and it was clear that they were in haste. After coming back from the room, he was
drinking very heavily, which I felt was to overcome his fear.

STATEMENT OF DEFENCE WITNESSES

Vijay Gupta (Waiter)

I am Vijay and I’m one of the head waiters at M/s Ambro Pvt Ltd. That day also, we went to
cater there for a birthday party. Everything was going smoothly and I remember that Kabir sir
also appreciated us for managing things so well and all the guests were happy with the food and
our services.

Then, after the dinner was over, we were preparing to wrap up our things, when suddenly
Deepak, one of my colleagues told me that there was some confusion regarding the bill which I
prepared as told by Mr. Raj Malhotra, our organiser and therefore, sir was calling me. I and
Deepak went into the room where the organiser sir and Kabir sir were discussing the bill. Seeing
us come in, Kabir sir thought that we were trying to overcharge him and so, he started shouting
at us. Argument ensued. Finally, I showed them all the bills on my company’s iPad according
to which I prepared a final bill and handed it over to Raj sir. Raj sir, again checked all the bills
thoroughly on the iPad and showed it to Kabir Sir. After checking everything, and making sure
that all was in order, Kabir Sir opened his safe, took out a black bag from it and handed it over
to Raj sir.

I haven’t done anything I am getting falsely accused of. I still regret working on that night and
joining that Ninecraft server on Raj sir’s advice. I usually used to play rub-g but recently
organiser sir and myself along with some other head waiters started playing ninecraft. I used to
enjoy Ninecraft simply as a game, I did not know what all was going on in that game.

Dinanath Chauhan (Chairperson and Managing Director, M/s Ambro Pvt Ltd)

I am Dinanath Chauhan, the Chairperson and Managing Director of M/s Ambro Pvt. Ltd. We
have a reputation of being the most premium and the highest quality catering service in North
India. We had catered a birthday party that had taken place on the intervening midnight of
04.07.2023 and 05.07.2023, by Mr. Kabir Singh, a very wealthy business tycoon.

A contract was executed between the Company and Mr. Kabir Singh on 15.06.2023. The
Company sought a minimum guarantee of 500 persons which was objected to by Mr. Kabir
Singh, citing that the total invitees were not more than 500, and even from those 500, it was not
necessary that all would be in attendance. However, upon further convincing and because he
wanted this particular company to cater at the party, Mr. Kabir Singh agreed to give a minimum
guarantee of 500 persons. I was a bit surprised because even though he might face losses upon
choosing us, he still went ahead with us.

The trade custom regarding payment involving such parties is to pay an advance of about 35-
40%, which is to be used for making arrangements for the party, and receive the remainder of
the payment after the event. However, Mr. Kabir was adamant that a provision be inserted in
the contract that the entire amount, that is, 100% of the bill shall be serviced upon the conclusion
of the event. Such an arrangement was unacceptable to us, and hence, we negotiated that 100%
of the payment would be made during the event, though it may be made towards the end of the
same. Hence, it being acceptable to both parties, it was agreed that the payment would be made
after the event, which was to happen at midnight.

It was further agreed that the payment was to be collected by the organiser, Mr. Raj Malhotra
from Mr. Kabir Singh, in the form of cash. An e-bill, duly signed by me, in my capacity as
Chairperson and Managing Director, M/s Ambro Pvt Ltd, was prepared beforehand, and the
same would be handed over to Mr. Kabir Singh at the time of making the payment by Mr. Raj
Malhotra, the organiser. Any further additions to the e-bill were to be done on the spot only.

A team consisting of about 20 waiter-staff, 10 cooks, 7 kitchen staff, 5 cleaners and 2 event co-
ordinators, headed by one organiser, Mr. Raj Malhotra was sent to the address given by Mr.
Kabir Singh, for making arrangements, organising and overseeing the birthday party.

I had gotten a call at around 1 by Raj, our Organiser to inform me regarding a disagreement
regarding the bill that had ensued between my staff and Mr. Kabir but because I had a long day

at work, I had slept early that day and couldn’t take the call. The next day, suddenly I get the
news that some of my waiters including our organiser had been arrested for an alleged offence
at the party that had happened on 4th of July.

Nilima Kakkar (Retired Indian Foreign Service Officer)

My name is Nilima Kakkar. I’ve been a neighbour of the Singhs for the past 3 years. Preeti,
Kabir’s wife is a good friend of mine. We share the same friend circle and every Sunday we
go to the Dhinloya Gymkhana Club for our weekly get-together. Even though I have good
terms with the Singhs, I always felt something was fishy about them. Kabir and his brother
Paramjeet always pretended to have amicable relations as if to ensure that their company’s
goodwill and the trust of the board of directors in them was not dissipated, even though they
had never really gotten along. One can easily observe this from the fact that even on Sherman’s
(Kabir and Preeti’s son) birthday, which was an opulent and lavish affair, no member of
Paramjeet’s family was in attendance.

I was appalled when I got to know that the Organiser, Raj Malhotra along with other waiters
of the famous and well-renowned M/S Ambro Pvt. Ltd. had been arrested for suspicion of
causing the alleged offence at Sherman’s (son’s) birthday party. I cannot accept that Raj along
with his team can do such a thing as I had also hired services of M/s Ambro Pvt. Ltd. for a
party that I organised at my south Dhinloya farmhouse last month. All the catering staff was
extraordinarily professional, extremely polite and dedicated towards their job. Also, when a lot
of food got spoiled due to rain, Raj went out of his way to compensate me for the same and did
not charge a single penny from me. Such is his character.

Also, my belief of the innocence of the catering staff and suspicion against the Singhs rests on
the fact that during the birthday party, Preeti came to me at around 1 am and happily exclaimed
that Kabir had told her that all the problems regarding the Singh’s company will be over from
tomorrow and all the board of directors will have exceptional trust on the Singh brothers’
closeness.

I’m a very strong supporter of social justice and I cannot stand any injustice. Considering
dubious and avaricious behaviour of the Singhs and exceptionally good character of the
catering staff, I have come to give evidence in support of the catering staff.

Raj Malhotra - Organiser (Main accused)

I am Raj Malhotra and I work as an organiser at the renowned M/S Ambro Pvt Ltd. On the 4th
of July, we went to cater at Kabir Singh’s farmhouse for his son’s birthday party. Everything
was going on smoothly, except when after the event Kabir sir had some doubts regarding the
bill which led to a little argument, which was later cleared by us. The event meant nothing more
than a usual workday to me. I am very befuddled and jumbled right now and am unable to
accept how have I been accused of something I have no idea about.

Playing Ninecraft and meeting Rani is my biggest regret. Rani and I met through ninecraft
only. It was she who suggested the 4th of July party. Mr. Kabir Singh was her friend. I was
looking for her at the party but I was surprised and puzzled on not seeing her there. She called
me at around 12 am but I couldn’t pick the call as I was busy in wrapping things up and
preparing the bill. It was her who used to make houses on the server and be active on the server
for most of the time.

I have been tricked and trapped. I am being used and being falsely accused of such heinous
crimes.
