1. A, a child of 6 years steals a pen and gives it to his father B. B uses it without
asking anything about it to the child. Decide the liability of A and B if any?
2. A, a child of 6 years steals a mobile phone and gives it to his father B. B uses
it without asking anything about it to the child. Decide the liability of A and B
if any?
3. A, instigates X, a child of 6 years to steal the mobile phone of B. The child
steals the mobile phone of B and gives it to A. Discuss the liability of A and
X.
4. X, an executive engineer entertained a suspicion and a notion that his wife is
practicing witchcraft as a result of which his health is deteriorating. He was
upset with this fact and one day he killed her with an axe. X pleads the
defence u/s 84. Can he succeed?
5. A, effected an entry in to a market through a bamboo fence to watch the fair
instead of the main gate in order to evade entry fee. The market committee
filed a case for criminal trespass against A. Discuss the liability of A.
6. Accused was a food grain dealer who applied for license and paid the licence
fee. Without the knowledge of rejection (beyond a certain limit) of his
application he purchased food grains and sent the return to licensing authority.
The licensing officer found that the quantity of food grains was in excess
of the quantity that was permitted. Can the accused be exempted from liability
on the ground of mistake of fact under section 76?
7. The police raided the house of B and found that he was in possession of
material that may be used for counterfeiting coins. However, there was no
evidence of his having used the material for counterfeiting coins. Can the
accused be held liable for any offence under IPC?
8. X takes his son Y who is three years old, for bathing to the well. He throws
his son inside the well so that the son can have a good bath. After 10 minutes
he also jumps into the well to take bath and get his son out of the well. Both
were rescued by the villagers but his son was found dead. X pleads the
exception of insanity. Decide
9. X, a woman, ran to a well crying and shouting loudly that she is going to
jump into the well and commit suicide. Just before she could jump, Y caught
hold of her and prevented her from jumping in to the well. The police charged
her with attempting to commit suicide. She however pleaded that her act was
still at the stage of preparation and does not amount to attempt. Decide.
10. X in his dream was commanded by someone in paradise to sacrifice his five
year old son. On the next morning he took his son, to a nearby mosque and
killed him by thrusting a knife in his throat. Then he went straight to his
uncle, but finding a village chowkidar nearby, took the uncle to a tank at some
distance, and then narrated the whole story to him. On being prosecuted X
took the plea of insanity? Decide.
