ANAND BHOMA Uniform Civil Code given under Article 44 of the Indian Constitution which proposes to replaces all the personal laws in India which are based on the scriptures and customs of each major religious community in the country that provides for a set of rules governing every citizen from different communities. Uniform Civil Code under Article 44 of the Indian Constitution is a Directive Principle of State Policy which states that “The state shall endeavor to secure to secure for the citizens a Uniform Civil Code throughout the territory of India”. Uniform Civil Code has emerged into India’s political discourses mainly because of Muslim women, affected adversely by the personal laws, have begun knocking on the doors of the Supreme Court to uphold their fundamental rights to equality and liberty in keeping with the constitutional provisions. So law ministry has asked the law commission to examine the matters in relation to the implementation of the uniform civil code. Uniform Civil Code has been a debated topic in India for a long period of time regarding its implementation. There are various debates for and against the uniform civil code among different communities in India. Uniform Civil Code basically aims to provide equal status to all the citizens of the country irrespective of their gender, caste, color, creed, religion, etc. but there are many arguments against the uniform civil code as there are many practical difficulties due to the various religious diversity in India so its implementation will be difficult. Through this project I would like to research about how Uniform Civil Code will have an impact on the different religious communities of India and specifically women. To study the different pros and cons of the Uniform Civil Code. How the implementation of Uniform Civil Code will affect the society at large? How uniform civil code led to different riots especially with Muslim community and Triple Talan. Uniform Civil Code can emerge through an evolutionary process which can preserve India’s rich cultural heritage of which all personal laws are equal constituents. The implementation of Uniform Civil Code may not necessarily usher in the expected equality among genders and religions. Uniform Civil Code aims to bring uniformity throughout the country among different religion and among people with different ideologies. Major Sanitization and are needed to reform current personal law reforms which should first be initiated by the communities themselves. Current institutions need to be democratized and strengthened for this change. Sincere efforts towards women empowerment have to be taken for all women of all religions.
