NOTIFICATION
NO.1198/87-Add. Energy Sources Deptt.-2018, Date 26 July 2018

In exercise of the powers conferred by section 15 of the Energy Conservation Act


2001 (Central Act No. 52 of 2001),the State Government in consultation with the
Bureau of Energy Efficiency do hereby adopts the following code and issues
directives for efficient use of energy and its conservation in the buildings or building
complexes namely:-

a) This code may be called the Uttar Pradesh Energy Conservation Building Code
(UPECBC) 2018.

b) Housing and Urban planning Department or Concerned Development Authorities/


Infrastructure and Industrial Development Department or Concerned Industrial
Authorities in their respective jurisdiction would be as the enforcing authority for
implementation of the UPECBC. The Concerned Departments/Authorities shall be
responsible for administrative requirements as mentioned in the code.

c) Uttar Pradesh New and Renewable Energy Development Agency


(UPNEDA)/UPSDA) will be the nodal agency to monitor the implementation of the
Code at the State level and also to create the awareness of the ECBC.

d) It shall come into force from the date of its publication in the Official Gazette.

e) Compliance with Uttar Pradesh Energy Conservation Building Code


(UPECBC)

(i). The Code is applicable to buildings or building complexes that meet either of
following:

(a) has a connected load of 100 kW or greater; or

(b) has a contract demand of 120 kVA or greater; or

(c) plot area of the building is more than 1000 m2 with minimum 2000 m2 as built-
up area (excluding basement)
Buildings intended for private residential purposes are not covered by the Code.

(ii). The code is mandatory for all new buildings, as stated above, to comply with
UPECBC with prescriptive/whole building performance method of compliance for
the buildings. The prescriptive method given in provisions 4 to 7 and whole building
performance method is given in provision 9 of UPECBC.
(iii) At the time of plan approval, the Owner/Builder/Developer shall submit the
UPECBC compliance, duly signed by Self and Architect against the mandatory
requirement of compliance of UPECBC to Housing and Urban Planning Department
or Concerned Development Authorities / Infrastructure and Industrial Development
Department or Concerned Industrial Authorities in their respective jurisdiction.
(iv). After completion of building construction, the Owner/Builder/Developer shall
submit the UPECBC compliance documents, signed by Self and BEE Empaneled
ECBC Expert describing that the building has been built in accordance with the
approved design and plan. Once the self-declaration duly verified by BEE
Empaneled ECBC Expert is submitted along with other necessary approvals under
the rules of Housing and Urban Planning Department or Concerned Development
Authorities / Infrastructure and Industrial Development Department or Concerned
Industrial Authorities in their respective jurisdiction, ECBC compliance will be
treated as completed.
