Dear Sir,

We regret to inform you that your OWN DAMAGE CLAIM filed under Policy No.GC-
PCV-100599870 involving the insured unit, 2020 FORD RANGER 2.0L RAPTOR
4X4 AT with Plate/CS No. C2V486, loss/s of February 29, 2020 cannot be acted upon
favorably.

Based on the submitted documents, the insured unit at the time of the accident was being
driven by Mr. Hassan Siaman Udsiman who is in possession of NON-
PROFESSIONAL DRIVER’S LICENSE with no. M05-17-000702 with issuance date
of March 29, 2017.

However, as per verification Mr. Hassan Siaman Udsiman “is our official family driver”
who is in possession of a non-professional driver’s license only.

In view thereof, the said claim is not compensable since there is a patent violation of the
AUTHORIZED DRIVER CLAUSE of the Policy which reads as follows:

“AUTHORIZED DRIVER:

Any of the following:


b. Any person driving on the Insured’s order or with his
permission. Provided that the person driving is permitted, in
accordance with the licensing law or other regulations, to
drive the Scheduled Vehicle, or has been permitted and is not
disqualified by order of a Court of Law or by reason of any
enactment or regulation in that behalf, provided that for
Sections I and II only of this Policy an authorized driver shall
include a duly licensed driver but whose license at the time of
the accident had expired.”

Moreover, the General Exceptions of the Policy, specifically Item No. 1


provides and we quote:
GENERAL EXCEPTIONS

“The Company shall not be liable under any Section of this Policy in respect of

1. Any accident, or liability caused, or incurred


(a) xxx
(b) whilst any MOTOR VEHICLE in respect of which
indemnity is provided by this Policy is:
(i) xxx
(ii) being driven by any person other than an Authorized Driver.”

Further, the Land Transportation Code provides under Republic Act No. 4136,
Section 3 (e) and we quote:

“Professional Driver” shall mean every and any driver hired or


paid for driving or operating a motor vehicle whether for
PRIVATE USE or for hire to the public.”

We wish to commiserate for the loss our Assured have suffered, while we have no other
recourse but to decline liability on the subject claim based on the breach of the authorized
driver provision of the Policy.

We refer to you the subject claim for your proper disposition.
