13.03.24 Today case record is fixed for hearing/order on the
petition filed by the plaintiffs under Order VI Rule 17 r/w
Section 151 of C.P.C.

Plaintiffs as well as defendant no.1 filed attendance


through their lawyer.

Heard learned counsel for the petitioners.

Ld. Counsel for the petitioners submits that the


petitioners have filed the instant suit for preliminary decree
for ¼ share over the land described in the schedule-A of
the plaint and other reliefs. The plaintiffs by way of instant
amendment petition prays for necessary correction in the
following manner:-

I. That page no.11, para-11, line 2 after the word Plaintiffs


“Defendant no.1 & 2” be allowed to insert.

II. That page no.12, para-12, line 4 word “3” be allowed


to be deleted and its place “1” be allowed to incorporate.

III. That page no.13, para-15 line 1 after the word Plaintiffs
contd.
“and Defendant no.1 & 2” be allowed to insert.

IV. That page no.13, para-18, line 1 after the word


Plaintiffs “and Defendant no.1 & 2” be allowed to insert.

The said amendment is formal in nature. It will not


change the nature and character of the suit. It is, therefore
prayed to allow the amendment petition of the plaintiffs.

Considering submission of Ld. Counsel for the


petitioners and perusal of case record I find that the
proposed amendment is merely an addition of some relevant
facts which is a typographical mistake committed by the
petitioners. Such type of typographical mistake will not
change the nature and character of the suit.

Therefore, in these circumstances the amendment


prayed is allowed. Petitioners are directed to make
necessary correction within 14 days of order on or before
next date of hearing. Accordingly, MCA No.430/24 is
disposed off.

Put up on 20.03.24 for hearing.
