HIPAA Can’s and Can not’s

POA- Power of Attorney-

o Can obtain information AND make changes when/as needed


 Becomes VOID once the member has passed

HIPAA Contact-

o Can obtain information, never make changes

Signature on the application- HIPAA Contact-

o Can obtain information, never make changes

AOR- Appointment of Representative-

o Can obtain information related to Appeals & Grievances


 Can NOT make changes

Durable Power of Attorney-

o To be used WITH the POA once a member becomes incapacitated.

Executor of Estate -

o Used when a member passes away


 Can make changes when/as need

Guardian- (should be treated like a POA)

o Can obtain information AND make changes when/as needed.


 Becomes VOID once the member has passed.
A legal guardian is a person who has been appointed by a court or otherwise has the legal authority to
make decisions relevant to the personal and property interests of another person who is deemed
incompetent, called a ward
