NATIONAL LABOR AGREEMENT FOR THE. DECOMMISSIONING, DECONTAMINATION AND DEMOLITION OF NUCLEAR POWER GENERATION FACILITIES Between HOLTEC DECOMMISSIONING INTERNATIONAL, LLC (HDI) And LABORERS’ INTERNATIONAL UNION OF NORTH AMERICA INTERNATIONAL UNION OF OPERATING ENGINEERS INTERNATIONAL BROTHERHOOD OF ELECTRICAL WORKERS UNITED BROTHERHOOD OF CARPENTERS and JOINERS OF AMERICA INTERNATIONAL ASSOCIATION OF BRIDGES, STRUCTURAL, ‘ORNAMENTAL AND REINFORCING IRON WORKERS ‘This Agreement is entered into on January 31, 2022, and shal become effective on the date that all parties become signatory. This Agreement is btween HD! (herein referred to 28 the "Contractor located at 1 Holtec Boulevard, Camden, Nu 08104 and those International Unions listed hereinafter (herein refered to asthe "Unions" forthe purpose of decommissioning, decontamination, demolition, and site restoration of Nuclear Power Generation Sites located inthe United States of America (hereinafter refered to as the Projects’). The scopes ofthese projects are defined inthis document in Article 1, Seton 6 “Tho Unions are composed of he following Itoratonal Unions Laborers Intemational Union of Nora America International Union of Operating Engineers International rotherhood of Electrical Workers United Brotherhood of Carpenters and Joiners ofAmerca Intemational Association of ridges, Structural, Omamental and Reinforcing on Weer COVENANTS Whereas, the Contractor is engaged in the business of implementing and providing technologioa and services related tothe decommissioning, dovontaminaion, demeition ond site restoration of Nuclear Power Generation Stes and this work i of importance to the Unions herein listed, and it being recognized there isan essential cfference in the Conaltions require to perform this type of work, the Unions herein listed with the Contractor ‘ish to enter into the agreement for their mutual benefit covering work ofthis nature; ‘Whereas, the Unions have in ther memibership throughout the United States have ‘members competent and qualified to perform the work ofthe Contractor, ‘Whereas, the Contractor has employed members ofthe Unions and the Contractor has a commitment andfor contract for work recognized by the Unions as being within the {uisceton of said Unions; ‘Whereas, in order to ensure relative equty and uniform interpretation and applcatin, the Unions wish to establish and administer tis Agreement in concert, each withthe othe, and the Contractor, Whereas the Contractor and the Unions desire to mutually stabilize wages hours and Working conditions; and Whereas, the Contractor andthe Unions agree thet, due to the particular nature ofthe work covered by this Agreement, there shall be no lockout or strikes during the life ofthis ‘Agreement, and provisions must be made to achieve this end; Its, therefore, agreed by the undersigned Contractor and Unions in consideration ofthe ‘mutual promises and covenants contained herein thatthe National Agreement be made as follows ARTICLE |- PURPOSE AND SCOPE, ‘Seaton 4, This Agreements forthe joint use and benefit ofthe contracting partes, and the provisions herein defied and set forth shal be construed as binding upon and effective in determining the relations between the panies and/or subordinate sub-cvisions to set forth herein the basic Agreement covering the rates of pay, hour of work, and conditions of employment to be observed by the patie. The Unions and Contractr(s) agree to abide bythe terms and coneitions contained inthis agreement with respect tothe administration af the agreement by all pattos involved ‘Section 2. itis mutually understood thatthe folowing terms and consitons relating to the employment of workers covered by this Agreement have been decided upon by means of collective bargaining and thatthe follwing provisions wil be binding upon the Contractor and the Unions during the term ofthis Agreement and any renewel thereafter. Itis futher agreed {hat the employees working under this Agreement shall constitute a bargaining unt separate and distinct rom all others. This Agreement covers al terms and conditions of employment for decommissioning, decontamination, demoliion, and ste restoration of Nuclear Power Generation Sites throughout te United Sates. In adlion, this Agreement does not incude Construction, maintenance andlor the operation of any Nuclear Power Plan which may be Covered under another Agreement. Section 3. The Contractor will not be required to become signatory to any local area or ‘national collective bargaining agreement covering the work to be performed hereunder. This agreement becomes the sole source of agreement between the Contractor and the union on this work scope as defined in Arte 1, Section 5. Section 4, In recognition ofthe special needs ofthese Projects and to maintain a spirit of harmony, labor-management peace and stabilty during the term of tis Agreement, the partes agree thatthe work will be done in a manner to secure optimum productivity ante ‘eliminate strikes, lockouts,stowdowns or interruptions or other disruptions of, interference with ‘or delay in the execution ofthe work covered by this Agreement. Similarly, the partes agree that there wil be no work stoppages, slowdowns or other dsruption of the work covered by this ‘Agreement resulting fom employees working onthe Project ste together with, alongside o in proximity to members of other unions not signatory to this Agreement ‘Section 5. The scope of this Agreements for ll work associated wth and required to decommission, decontaminate, demolish, and restore Nuclear Power Generation sites located In the United States of America to a predetermined end state. ‘This Agreement shal apply to all onsite construction work involved inthe performance of
