MOTION FOR RECONSIDERATION WITH COMPLIANCE OF THE


ORDER DATED 28 JULY 2023 AND WITH AMENDMENT

PETITIONER, by the undersigned counsel to this Honorable Court


respectfully states that:

1. On 28 July 2023, this Honorable Court issued an Order denying


the petition, thus dismissing it on several grounds. A copy of this Order
was received on 28 July 2023;

2. We beg the kind indulgence of this Honorable Court to reconsider


its dismissal of the petition and give it due course and set it for further
proceedings;

3. As to Section 32 (b) of R.A 8189, otherwise known as “The Voter’s


Registration Act of 1996”, we are of the belief that the “Notice of the Place,
date, and time of the hearing of the petition…” is function of the Honorable
Court to issue the necessary Notice as is usual in ordinary petitions;

4. Thus this notice form the Court is sent to the Board and the
challenged Voter upon filing of the petition by following:

4.1. We copy furnished the Election Officer of the Comelec of Pasay


City, among others which we submit is the Election Registration
Board (the “Board”) referred to in R.A No. 8189 ;

4.2. Copies of this Petition were personally served upon the


challenged voters by leaving a copy in the possession of a person of
sufficient discretion in the residence of the challenged voter as shown in
the following pictures from Brgy. 88, Zone 9, Pasay City;

4.2.1. ANNEXES “D” to “D-2” for Precinct No. 0359A


4.2.2. ANNEXES “D” to “D-2” for Precinct No. 0360A
4.2.3. ANNEX “D” for Precinct No. 0360B
4.2.4. ANNEX “D” with side note explaining why no pictures

4.3. We likewise sent through registered mail a copy of the Petition to


the challenged voters. Some were duly received but majority were
returned unserved due to reason “addressee moved out”;

Copies of the returned cards are hereto attached as ANNEXES


“A” to “A-48” - Motion for Reconsideration, while sixty four (64)
registered mail returned unserved with notation from the postman.

5. As to the requirement that a Petition shall refer only to one (1)


precinct and implead the Board as Respondents;

5.1. We filed eight (8) Petitions covering Precinct Nos. 0359A, 0360A,
0360B, 0361A, 0361B, 0361C, 0362A, 0362B of Brgy. 88 Zone 9,
Pasay City.

However, in the SCP-JEP system we were directed to pay our filing


fee based on the total of respondents (220 respondents), and not
per precinct;

As to impleading the Board, we furnished a copy of the Petition to the


Office of the Election Officer Atty. Datumama M. Macaindig of the
Comelec Pasay, among others;

6. As stated above, we served a copy of the Petition to the office of


Comelec Pasay City and the challenged voters by personal service to the
Comelec and by personal delivery and registered mails to the challenged
voters.

7. As stated above, we filed eight (8) separate petitions for the eight
precincts, but paid the filing fee for all the individual challenged voters in all
eight precincts. The amount of filing fee of Sixty Seven Thousand Seven
Hundred Twenty Five (P 67,725.00) Pesos is for all the total number of
challenged voters in these eight precincts. A photocopy of the Official
Receipt is hereto attached as ANNEX “__”; Motion for Reconsideration;

8. With due respect, we expected that these cases, assuming each


precinct will be assigned a case number, will be ultimately be consolidated;

9. Finally as to our annexes and exhibits stated in our petition;

9.1. We mentioned ANNEXES “A” to “D” inclusive, thus we attached


these as our annexes in the petition;

9.2. As to the Exhibits: Exhibits “A”, “B”, “D” and sub markings, “F”,”G”
and “H” are already attached to the Petition only Exhibits “C” and “E”
will be presented during trial

9.3. Further certificates as proofs of residency in another barangay of


the herein respondents are hereto attached showing that the following
respondents are non-residents in Brgy. 88 Zone 9, Pasay Cit, as follows:

“As the Court has expounded in Aguam vs. Court of Appeals:


The court has the discretion to dismiss or not to dismiss an appellant’s
appeal. It is power conferred on the court, not a duty. The
“discretion must be a sound one, to be exercised in accordance with
the tenets of justice and fair play, having in mind the circumstances obtaining
in each case.” Technicalities, however, must be avoided. The
law abhors technicalities that impede the cause of justice. The court’s
primary duty is to render or dispense justice. ”A litigation is not a
game of technicalities.“ “Lawsuits unlike duels are not to be won by
a rapier’s thrust. Technicality, when it deserts its proper office as an aid
to justice and becomes its great hindrance and chief enemy, deserves scant
consideration from courts.” Litigations must be decided on their merits
and not on technicality. Every party litigant must be afforded the amplest
opportunity for the proper and just determination of his
cause, free from the unacceptable plea of technicalities.
Thus, dismissal of appeals purely on technical grounds is
frowned upon where the policy of the court is to encourage
hearings of appeals on their merits and the rules of
procedure ought not to be applied in a very rigid, technical sense;
rules of procedure are used only to help secure, not override
substantial justice. It is a far better and more prudent course
of action for the court to excuse a technical lapse and afford the parties
a review of the case on appeal to attain the ends of justice
rather than dispose of the case on technicality and cause a grave
injustice to

the parties, giving a false impression of speedy disposal of cases
while actually resulting in more delay, if not a miscarriage of
justice”.13 (Emphasis supplied)

“The reduction in the number of pending cases is laudable, but if


it would be attained by precipitate, it not preposterous, application
of technicalities, justice would not be served. The law abhors
technicalities that impede the cause of justice. The courts primary duty is to
render or dispense justice. “It is a more prudent course of action
for the court to excuse a technical lapse and afford the parties a review
of the case on appeal rather than dispose of the case on technicality
and cause a grave in justice to the parties, giving a false
impression of speedy disposal of cases while actually resulting in
more delay, if not miscarriage of justice.”

What should guide judicial action is the principle that a party -


litigant should be given the fullest opportunity to establish the merits
of his complaint or defense rather than for him to lose life, liberty,
honor, or property on technicalities. The rules of procedure should be
viewed as mere tools designed to facilitate the attainment of justice.
Their strict and rigid application, which would result in technicalities
that tend to frustrate rather than promote substantial justice, must
always be eschewed. At this juncture, the Court reminds all members
of the bench and bar of the admonition in the often-cited case of
Alonso v. Villamar [16 Phil. 315,322(1910)]:

Lawsuits, unlike duels, are not to be won by a rapier’s thrust. Technicality,


when it deserts its proper office as an aid to justice and become its
great hindrance and chief enemy , deserves scant consideration from
courts. There should be no vested rights in technicalities. 26
(Emphasis and underscoring supplied)

Otherwise stated, procedural rules may be relaxed for the most


persuasive of reasons in order to relieve a litigant of an injustice not
commensurate with the degree of his thoughtlessness in not complying with the
procedure prescribed. Corollarily, the rule, which states that the
mistakes of counsel bind the client. May not be strictly followed
where observance of it would result in the outright deprivation of the
client’s liberty or property, or where the interest of justice so

requires.
In the instant case, the court notes that the dismissal of Curammeng’s
appeal is based solely on his counsel’s negligence in failing to
attached a certification of non-forum shopping as well as material
portions of the record. Notwithstanding the filing of a Motion for
Reconsideration with Compliance dated November 6, 2014 the CA
upheld its earlier dismissal, ratiocinating that the reasons presented
by Curammeng’s counsel were not compelling enough to relax the
technical rules on appeal.

PRAYER

WHEREFORE, PREMISES CONSIDERED, we respectfully moves


that the Order issued by this Honorable Court on 28 July 2023 dismissing
the instant Petition be reconsidered and set aside and issue a new Order
be issued giving the instant Petition be reinstated and set for further
proceedings.

Other reliefs just and equitable under the premises are likewise
prayed for.
