61/411/2023 titled Rajni Vs UT in its letter and spirit.

Sir/Madam,
1. That the applicant was engaged as Safaiwala in Govt. Medical College
Jammu vide Govt Order No. HME (NG) 184/2000 dated 23-11-2000 read
with endorsement No.AHJ/1542 dated 07-12-2000 issued by Principal
Govt. Medical College Jammu.

1. That in terms of J&K Civil Services (Special Provisions) Act, 2010, the
cases of employees covered under the Act are required to be submitted
to the empowered committee within 60 days in terms of section 10 of the
said Act. In respect of the employees who have completed seven years
on the date when the Act was enforced and a date to this effect was
fixed.

2. That recommendation for regularization of the services of the applicant


along with other similarly situated employees was submitted by the
Respondent No 2 to 4 to the Govt at different time.
3. That it is submitted that the empowered committee constituted in terms of
Section 10 of J&K Civil Services (Special Provisions) Act 2010 for
scrutiny and verification of cases of Adhoc/contractual/consolidated
employees were submitted the case of applicant to administrative
department for issuance of formal orders in their favour as per the J&K
Civil Services (special provisions) Act 2010. The said committee cleared
the name of applicant.

4. That despite recommendation by the empowered committee constituted


in terms of Section 10 of J&K Civil Services (Special Provisions) Act
2010 and clearance by the concerned department. The service of the
applicant is not regularized till date.

5. That applicant is working for the last over more than 22 years and has
not been regularized till date whereas performa respondent No.5 namely
Shri Karamat Ali despite a break of 76 days has been regularized.

6. That in view of the above mentioned position, the applicant was


compelled to approach the Honble tribunal to redress her grievance. The
applicant filed petition bearing OA No. 411 2023 titled Rajni v/s UT and
the Honble tribunal after hearing the matter disposed off the O.A vide
judgment dated 27 April 2023. Copy of the judgment is enclosed herewith
and marked as ANNEXURE-I.

It is therefore most humbly requested that kindly comply the


judgment passed by the Honble tribunal vide judgment dated 27-04-2023
in the interest of justice.
