Adv|ce at a Po||ce Stat|on
lf you have been arrested or if the police are to question you about a criminal offence
whether or not you have been arrested (known as being a "volunteer"j, you are entitled
to legal advice at a police station or elsewhere. Th|s adv|ce |s comp|ete|y free of
charge. There is no means test and there are no forms to complete.
ln some exceptional circumstances the police can delay, but not stop, you seeing a solicitor.
Adv|ce and Ass|stance
Under the Advice and Assistance scheme, we can carry out work on your behalf
in matters involving Criminal lnvestigation, Prison Law, Appeals and Reviews up to
prescribed limits. This scheme is, however, means tested and we will need to complete
a simple means form with you and we will ask you to provide proof regarding your
income and expenditure.
Adv|ce and Representat|on at Court
Mag|strates' Courts
lf you have been charged with a criminal offence, a Magistrates' Court may grant you
a Representation Order where it is satisfed that the interests of justice require that you
be represented before the court. A Representation Order covers the cost of advising
you, preparing your defence and representing you at court.
There is a means test but if you qualify you will not be asked to contribute to the costs
of your defence. We will help you to complete an application form which we will submit
to the court on your behalf.
Refusa| of Representat|on Order
lf your application for a Representation Order is refused, we will discuss with you your
right to re-apply. We can carry out approximately one hours non-means tested publicly-
funded work on your behalf prior to the initial refusal.
Crown Court
lf you have been charged with a criminal offence and you are committed, sent or
appeal to the Crown Court, a Magistrates' Court or a Crown Court may grant you a
Representation Order where it is satisfed that the interests of justice require that you
be represented before the court.
A Representation Order covers the cost of advising you, preparing your defence and
representing you at court. Although there is no qualifying means test, you will be
required to complete and submit a statement of means for use by the judge at the
Crown Court at the conclusion of the proceedings. That court may make an order for
you to pay towards the cost of your defence (known as a Recovery of Defence Costs
Order or RDCOj. An RDCO will not normally be made unless your income exceeds
22,235 per annum, your capital exceeds 3,000 or your house is valued at more than
100,000 after deducting any outstanding mortgage. An RDCO cannot be made where
you are appearing at the Crown Court as a result of a Committal for Sentence or an
Appeal against Sentence.
Costs not covered by the order
A Representation Order only covers the costs of work done by us on your behalf
under the Order. lt does not cover any costs which may be ordered against you e.g. if
you plead Guilty or you are found Guilty, you may be ordered to pay the costs of the
Prosecution in addition to any other penalty.
Advocacy Ass|stance
Mag|strates' Courts, Crown Courts, M|||tary Custody
Where a full Representation Order is not available for the type of proceedings upon
which you are to appear at court, it may still be possible for us to represent you in court
if the proceedings qualify for Advocacy Assistance.
Advocacy Assistance is generally only available for a limited class of cases and then
only up to a prescribed limit, which can be extended in certain circumstances. There is
no means test and you will not be required to contribute to the cost of your defence.
Advocacy Ass|stance - Pr|soners
Advocacy Assistance may be granted to an individual regarding his/her treatment or
discipline in prison or where (sjhe is the subject of proceedings before the Parole Board
if certain fnancial criteria are satisfed. Please ask for further details.

the police and your right to remain silent has not been
abolished. However, you will need legal advice before exercising your right to silence because it is possible that choosing not to answer questions may harm your
case later.
Legal advice in a police station is free of charge whether
you are under arrest or there as a volunteer.

Legal Aid will continue to be free of charge in the majority of cases although in the Magistrates' Court a
means test will apply and may result in some applicants
being ineligible for legal aid.
Some Crown Court cases may be the subject of a contribution order at the conclusion of proceedings. Stevens Solicitors are fully committed to the legal aid Scheme and will take all appropriate steps to deal with
your case under that scheme whenever it is possible. lf
you do not qualify for Legal Aid we will tell you. We have
a more detailed brochure about legal aid and we will be
