PART A: INTERPRETATION

In this Agreement, unless the context indicates otherwise, any word or expression to which
a meaning has been assigned in the skills Development Act, 1998 (Act 97 of 1998) (‘the
Act’) or the SETA Workplace Based Learning Programme Agreement Regulations, 2018
(‘these regulations,) shall have the meaning so assigned.

PART B: DEFINITIONS
For purpose of workplace-based learning programme agreements regulations only:

“apprenticeship” means a period of workplace-based learning culminating in an


occupational qualification for a listed trade.

“candidacy” means a period of workplace-based learning undertaken by a graduate as part


of the requirement for registration as a professional in the required professional designation
as stipulated by a professional body.

“internship for the “N” Diploma” means a period of workplace-based learning undertaken as
part of the requirement for the “N” Diploma.

“learnership” means a period of workplace-based learning culminating in an occupational


qualification or part qualification.

“student internship: Category A” means a period of workplace-based learning undertaken


as part of the requirement for a Diploma, National Diploma, Higher Education Certificate or
Advanced Certificate as vocational qualification stipulated in the Higher Education
Qualification Sub-Framework (HEQSF).

“student internship: Category B” means a period of workplace-based learning undertaken
as part of requirement for a professional qualification.

“student internship: Category C” means a period of workplace-based learning undertaken


as part of the requirement for the occupational qualification of the Quality Council for
Trades and Occupations (QCTO).

“graduate internship” means a period of workplace-based learning for the purpose allowing
a person who has completed a post-school qualification to gain workplace experience or
exposure to enhance competence and/or employability. This may include academic staff
with existing qualifications that need industrial exposure or experience.

“student internship” means a period of workplace-based learning for a person who is


enrolled at an education and training institution for a SAQA registered qualification and may
include vacation work.

PART C: TERMS AND CONDITIONS OF AGREEMENT

1. Declaration of the parties


We understand that this agreement is legally binding.
We understand that it is an offence in terms of the Act to provide false or misleading
information in this agreement.
We agree to the following rights and duties.

2. Rights and duties of learners, employers and providers

2.1 Rights of the learner


The learner has the right to:
2.1.1. receive an induction to the workplace-based learning programme;
2.1.2. be educated and trained under the workplace-based learning programme;

2.1.3. access to the required resources for all required curriculum components of the
work-based learning programme.
2.1.4. be assessed internally as specified and have access to the assessment results of
the workplace-based learning programme;
2.1.5. have access to final external summative assessments as specifies in the
assessment specification.
2.1.6. if successful, be awarded a certificate of competence, by the relevant body.
2.1.7. in the case of an unemployed learner, receive the agreed workplace-based learning
programme allowance for the duration of the learning programme; and
2.1.8. raise grievances in writing with the SETA concerning any shortcomings in the
quality of the education and training under the workplace-based learning
programme.

2.2. Duties of the learner


The learner must:
2.2.1. carry out all related work experience activities specified in the workplace-based
learning programme;
2.2.2. comply with the employer’s workplace policies and procedures;
2.2.3. be available for, and participate in, all knowledge, practical skills and work
experience activities required by the workplace- based learning programme;
2.2.4. complete timesheets and projects, and participate in all internal assessment
activities that are required for the final external summative assessment at the end
of the workplace-based learning programme; and
2.2.5. be available for the final external summative assessment of occupational
competence on the date and place scheduled.

2.3. Rights of the employer


The employer has the right to require the learner to:
2.3.1. perform lawful duties in terms of this agreement; and

2.3.2. comply with the rules and regulations concerning the employer’s workplace policies
and procedures.

2.4. Duties of the employer


The employer must:
2.4.1. comply with all duties in terms of the Act and applicable legislation including those
listed hereunder unless other legislation exists that is applicable to the employer
specifically:

2.4.2. provide the facilities and resources required for the work experience components of
the workplace-based learning programme;
2.4.3. provide the learner with supervision and mentoring at work;
2.4.4. release the learner during normal working hours to attend off-the-job components of
the workplace-based learning programme;
2.4.5. complete the learner’s work records;
2.4.6. keep up to date records of workplace learning and periodically discuss progress
with the learner and the provider;
2.4.7. if the learner was not in the employment of the employer at the time of concluding
this agreement, the employer must:

learning programme;

2.4.8. submit the signed learning programme agreement to the SETA for registration
within 30 days of contracting for registration.

2.5. Rights of the provider


The provider has the right to access the learner’s work experience records.
2.6. Duties of the provider
The provider must:
2.6.1. provide the knowledge and practical skills components specified in the work-based
learning programme;
2.6.2. provide the learner support as required by the workplace-based learning
programme;
2.6.3. record, monitor and retain details of the education and training provided to the
learner in terms of the workplace-based learning programme and periodically
discuss and record progress with the learner and the employer;
2.6.4. conduct internal assessments for the knowledge and practical skills components
specified in the workplace-based learning programme; and
2.6.5. issue statement of results.

3. Completion or termination of this agreement


3.1. This workplace based learning programme agreements is completed:
3.1.1. on the date as stipulated in this agreement as completion date; or
3.1.2. on an earlier date if the learner has successfully completed the final external
summative assessment and fulfilled all requirements associated with the specified
workplace experience activities of the work-based learning programme.

3.2. This workplace based learning programme agreement is terminated if:

3.2.1. the learner is fairly dismissed by the employer for a reason related to the learner’s
conduct or capacity as an employee; or

PRACTICAL VOCATIONAL TRAINING AGREEMENT
1. The Objective of the Agreement
a. Practical Vocational Training Agreement (“the Agreement”) entered into at Bloemfontein
on (date) 06/02/2024, between Umnga Farmers Training Group an agricultural workplace
entity, trading as Umnga Farmers and Izisiphe Manxeba (student), as candidate
practitioner/vocationalist.
b. This agreement is a supplementary agreement and an extension of the 3-Party
Learnership Agreement as signed between the Learner, the Training Provider, and the
Employer, and forms an integral part of the 3-Part Learnership Agreement.
c. The objective of this agreement is to arrange a relationship and a guideline between the
student and the responsible supervisor at a workplace, to enable the student to gain
practical skills through the assistance of a supervisor in the practical requirements as
prescribed in the training material and practical logbook as part of the qualification.
d. This agreement will be replaced by any other formal contract of employment and service
agreement, in the case where the student is a full-time employee in the workplace.

2. Terminology
Practical Workplace: A commercial farm where primary agricultural production takes
place, and/or a secondary agricultural factory where value-adding is taking
place.

Supervisor: A commercial farmer as a primary producer, and or a secondary


agricultural processing facility, representing a workplace, whereby the
Supervisor agreed to contribute to the achievement of a student of an
agricultural qualification. This agreement is primarily referred to as the
employer, supervisor, principal, evidence collector, appointed supervisor,
and experienced practitioner.

Training provider: The International Agricultural Academy for Africa (Pty) Ltd is the
appointed training provider in the 3-party learnership agreement.

Injury on duty: Any reference to an injury, physical or emotional, that the student
may suffer or experience at the Practical Workplace during the practical
training or exercise.

Practical logbook: The logbook provided contains the practical outcomes of the
specific qualification(s) as provided by the training provider.

Practical training: Any practical training exercise, or vocational training


demonstration, the student is observing or exposed to, under the strict
supervision of the supervisor at the workplace.

The student: The student as identified in the 3-Party Learnership Agreement and
this Agreement, also referred to as candidate practitioner/vocationalist.

3. Responsibilities

a. The student
i. The student shall be responsible to study the theoretical material that includes
descriptions and explanations of all the practical requirements, as also clearly set out in
the specific outcomes and assessment criteria, and the practical logbook.
ii. The student shall be responsible to find a suitable practical workplace to gain practical
experience under the supervision of an experienced supervisor who will sign the
logbook as an evidence collector.
iii. The student shall Introduce the identified workplace/s and responsible supervisor/s to
the responsible assessor/manager of i3A.
iv. The student shall be responsible to inform the workplace supervisor of the specific
outcomes and assessment criteria for all practical tasks to be executed.
v. The student shall have the responsibility of attending the practical workplace within the
guidelines of wearing the necessary protective clothing and equipment required to
perform the tasks.
vi. The student shall be solely responsible to arrange all necessary accommodation, meals
and transportation required by him or her. Such arrangement should be done by
mutual agreement between the student and the workplace supervisor.
vii. The student shall be primarily responsible to complete all practical tasks according to
the logbook, having each activity duly signed by a supervisor, and submitting the duly
completed logbook to the responsible assessor of i3A.
viii. In the case that the student is well experienced in the practical requirements, due to
past experience, and would like to apply for competence through Recognition of Prior
Learning (RPL), it is the responsibility of the student to arrange with an experienced
supervisor to acknowledge the practical experience by signing off each activity in the
practical logbook.
ix. The student undertakes to never perform any tasks at the workplace if not under the
direct supervision of the supervisor or an appointed representative of the supervisor. If
the supervisor suffers any damages or loss of stock or equipment due to an
unsupervised action undertaken by the student, the student is in breach of contract and
can be held responsible in his or her individual capacity for any losses suffered by the
workplace.

b. The Supervisor

i. The supervisor will agree on a mutual basis with the student to assist him or her, in an
identified workplace, at specific times according to the specific production season, to
gain the practical experience as required by the specific outcomes and assessment
criteria of the qualification, as also detailed in the practical logbook.
ii. The supervisor will review the practical outcomes and assessment criteria as detailed
in the qualification and practical logbook, and agree with the student on a specific
programme whereby the student will visit the workplace at times scheduled with the
purpose to gain practical experience in all required practical aspects
iii. The supervisor will use his or her best efforts to teach, instruct, demonstrate and
expose the student according to the best practices in agriculture, to execute the
practical task as prescribed by the industry.
iv. The supervisor will make the student aware that at all times when exposed to the
practical handling of animals, such animals are handled and treated according to the
ethics and best practices of humanity, as prescribed by the code of best practice in
the industry.
v. As per the agreement in Par. b. i. above, the supervisor will make available to the
student all necessary equipment, machinery and/or infrastructure so that the student
can perform the practical exercises.
vi. The supervisor will see that the student is inducted according to the workplace
Occupational Health and Safety requirements and policies as prescribed in the
applicable OHS Act.
vii. The supervisor will see that the student is wearing the required safety clothing and
equipment to perform practical tasks at the workplace as per the workplace
Occupational Health and Safety requirements.
viii. The supervisor will appoint, where needed, an assistant supervisor or another
responsible person to assist the student to:
1. Attend practical activities;
2. Demonstrate how a specific task is done;
3. Explain the reason for the task to be done;
4. Allow the student to do a task as part of the practical learning process;
5. Observe the student’s ability and competency to execute the task;
6. Sign the logbook at the specified task as proof of completion of the task by the
student.
ix. The supervisor will ensure that the student is never allowed to perform any tasks at
the workplace without the direct supervision of the supervisor or an appointed
representative of the supervisor. If the supervisor suffers any damages or loss of stock
or equipment under a strict supervised action of the student, the student will be
indemnified against any claims due to the loss.
x. The Supervisor will always act professionally, within the principles of integrity and
responsibility towards the agricultural profession, and according to the common trust
put in the person.

c. International Agricultural Academy for Africa (Pty) Ltd


i. I3A will act as the accredited institution and training provider responsible for the offering
of the qualification within the provisions and responsibilities as contained in the 3-Party
Training Agreement between the student, the training provider and the employer.
ii. I3A will provide theoretical information, manuals and a practical logbook within the
administrative and quality assurance requirements of the QCTO of the AgriSETA.

4. Indemnification, Termination, Dispute and other Legal aspects of this agreement


a. This Agreement is not a Contract of Employment and/or Service Agreement between the
student and the Supervisor, and at no time may this Agreement be interpreted, or may
the expectation be created by the student, that the supervisor will have any financial,
contractual, or any other obligation towards the student.
b. No financial remuneration or any other type of payments such as contributions to the
Unemployment Insurance Fund, COIDA, or any other type of workman compensation, or
any in-kind contributions, is payable to the student by the supervisor, or by any
representative of the supervisor, or by a representative of the workplace.
c. The student, by signing this Agreement, agrees that he or she will at all times enter the
workplace at his or her own risk, and indemnifies the supervisor, and any of its
representatives or employees, against any claims that may arise due to injuries,
expectations, or any other claims that may arise for whatever reason.
d. The student, by signing this Agreement, indemnifies i3A as the training provider, and any
of its representatives or employees, against any claims that may arise due to injuries,
expectations, or any other claims that may arise for whatever reason.
e. This Agreement is based on the principles of mutual respect and goodwill between all
parties. If any party at any time during the execution of this Agreement feels
uncomfortable at any time, for whatever reason, such a party may cancel this agreement
by means of a short written notice to the other two parties, without having to disclose a
reason for cancellation, and without any further obligations, whatsoever, to any of the
