Subject: Request for Exemption from ESIC Compliance and Monthly Return Filing
Dear Sir/Madam,
I am writing to formally request an exemption for my company, S Jena Associates (OPC) Pvt
Ltd, from ESIC compliance and the filing of monthly returns.
As per my earlier correspondence dated 21/05/2024, I had informed your office that my business
does not require any employees and that I personally manage all the work. In response, I
received a notice dated 02/09/2024 from your office stating that I am obligated to file NIL
returns until I hire employees.
I would like to clarify once again that my business currently has no employees and that I have no
intention of hiring anyone in the foreseeable future. Filing NIL returns in this situation creates an
administrative burden for my single-handedly managed business, which has no obligations under
the ESIC Act.
In view of the above, I kindly request you to exempt my firm from the requirement of filing
monthly NIL returns. I assure you that if there is any change in the employment status or any
need for compliance in the future, I will immediately notify the ESIC office and fulfill all
necessary requirements as per the law.
I hope you will consider my request sympathetically and provide the necessary exemption at the
earliest.

I am writing to formally request an exemption from the ESIC notices I have been receiving
regarding the non-filing of returns.
I would like to clarify that my business, S.Jena Associates (OPC) Pvt Ltd, is currently operating
without any employees. Due to the nature of my business and its current operational
requirements, there is presently no need for employees.
Therefore, I respectfully request that the requirement for filing regular NIL returns be
reconsidered, as it has become a tedious and burdensome task. While I fully acknowledge my
responsibility to comply with the law, the continuous filing of NIL returns imposes an
unnecessary burden on my business. If there is any possibility of closing my ESIC account
without the need to strike off my company, I would be most grateful for your guidance on how to
proceed.
I have made several attempts to convey this to the ESIC office, but have been directed to various
branches such as Bibewadi and Akrudi, without receiving a satisfactory resolution.
