AFFIDAVIT

I, Joy Reyes, of legal age, married , Filipino citizen and a resident of Mabolo Cebu City, after having been legally sworn to depose and say THAT:

1. I personally know the complainant , Efren Aying and the respondent Maricel Aying because they are my neighbors in Mabolo Cebu City. We live in the same community . 2. My residence is just across the residence of the Aying spouses. Thus, I am a witness to some of the events that take place in the vicinity of their residence.
3. I know for a fact that Efren Aying went to Manila to process his paper

for his employment as a seaman.

4. While Efren Aying was in Manila, there were many times that I saw a

policeman always in the conjugal dwelling of the Ayings. Maricel Aying always accompanied the man whenever he goes inside the house of the spouses.
5. I have personally seen a number of times that her paramour goes inside

the conjugal dwelling of the Ayings and leaves the same at about the wee hours.
6. I have also personally seen Maricel and her paramour go inside one of

the motel here in Mabolo . Whatever happened inside the motel, only she and her paramour know; 7. I am executing this affidavit freely, voluntarily and without any consideration.
