On 3-3-2012 at about 2243 hours I (Ofc. Klute) responded to the Centro Restaurant located at 950 Pearl Street, City and County of Boulder, State of Colorado reference a tone-alert for a possible robbery in-progress by a man armed with a knife. Officer Colvin responded to the same call and arrived on scene before I did. Upon arrival I contacted Officer Colvin who had just placed a man, identified by his Arizona Driver's License as Robert Webber Engles (2-2-1970), into custody. scene to assist. Officer Colvin stated Engles was identified by Centro employees as the man with a knife and had attempted to leave the restaurant by cutting a hole in the plastic "wall" that surrounded the outdoor patio. Centro employees Rye William Cook-Biggert (11-20-1988) and Alan Johnson (9-29-1971) had followed Engles and restrained him until Officer Colvin was able to place him under arrest. Officer Colvin obtained a black CRTK folding knife from Johnson who stated it was the knife used by Engles to cut through the wall. I took possession of the knife and later transported it to the Boulder Public Safety building where it was entered into Property and Evidence. Officer Fitzgerald, Sergeant Byfield and I conducted a brief canvass of the restaurant and obtained written statements from several Centro employees and one customer who witnessed the entire event. According to both victims and observers, Engles had been drinking at the Centro Bar and initially attempted to leave without paying for his drinks. When confronted by Johnson regarding his outstanding bill, Engles attempted to leave the bar by walking out onto the patio, opening a folding knife then cutting an approximately 4-foot slit in the plastic wall surrounding the restaurant patio. Engles exited through the cut, closely followed by Johnson. The area into which Engles emerged was enclosed by a metal fence, approximately 4 feet in height. Finding no immediate exit, Engles turned to confront Johnson who seized the hand holding the knife. Cook-Biggert observed the confrontation and ran to the front of the restaurant, leapt over the fence and assisted Johnson in restraining Engles until Officer Colvin arrived. Both Cook-Biggert and Johnson stated they felt threatened by Engles and were very concerned that he was armed with a knife. See statements by Cook-Biggert, Johnson, Whitney Rothe (7-14-1987), and Mary Miller (8-31-1980). Officer Fitzgerald took several photos of the damaged wall and entered the photos into property and evidence (see Officer Fitzgerald's property report). According to Centro's manager, Alison Webster (12-20-1986) the damage to the patio wall is estimated as $600.00. Webster provided us with a receipt detailing Engles outstanding bill, totaling $33.00. Engles was transported to the Boulder County Jail by Officer Colvin where he was booked and jailed. Upon arrival at the jail, Engles became increasingly hostile and combative with jail personnel and was placed into a holding cell. I provided victims and witnesses with contact information and victim's rights pamphlets as needed. I proceeded to the Boulder County Jail to speak with Engles, but was unable to do so as he was both combative and still in a holding cell. This case is cleared with an adult arrest.
