SURROGACY AGREEMENT
This Surrogacy Agreement (the "Agreement") is entered into on this ___ day of __________, 20__,
by and between:
1. Intended Parent(s): [Name(s)], residing at [Address in New York], hereinafter referred to as the
"Intended Parent(s)"
2. Surrogate: [Name], residing at [Address in Nigeria], hereinafter referred to as the "Surrogate"
Collectively referred to as the "Parties."
RECITALS
WHEREAS, the Intended Parent(s) desire to have a child and have chosen the Surrogate to carry
and deliver the child;
WHEREAS, the Surrogate agrees to carry and deliver the child for the Intended Parent(s);
WHEREAS, the Parties intend for the Intended Parent(s) to be the legal parent(s) of the child;
NOW, THEREFORE, in consideration of the mutual promises contained herein, the Parties agree as
follows:
1. Purpose of the Agreement
This Agreement establishes the rights and responsibilities of the Intended Parent(s) and the
Surrogate concerning the surrogacy arrangement.

2. Compliance with Laws
The Parties acknowledge and agree to comply with:
- The surrogacy laws of the State of New York, USA;
- The immigration laws of the United States and Nigeria;
- Any other applicable laws.
3. Medical Procedures
The Surrogate agrees to undergo in-vitro fertilization (IVF) and other medical procedures necessary
for embryo transfer and pregnancy.
4. Parental Rights
The Intended Parent(s) shall have sole legal and physical custody of the child upon birth. The
Surrogate waives any claim to parental rights.
5. Compensation and Expenses
- The Intended Parent(s) agree to compensate the Surrogate in the amount of $[Amount], payable in
installments as follows:
- Upon confirmation of pregnancy: $[Amount]
- During pregnancy (monthly): $[Amount]
- Upon delivery of the child: $[Amount]
- The Intended Parent(s) shall cover all reasonable medical, travel, and legal expenses incurred by
the Surrogate.
6. Health and Lifestyle Requirements

The Surrogate agrees to:
- Follow medical advice provided by healthcare professionals;
- Abstain from alcohol, smoking, and illegal drugs during the pregnancy;
- Maintain a healthy lifestyle.
7. Confidentiality
The Parties agree to keep the terms of this Agreement and the surrogacy process confidential.
8. Termination of Agreement
This Agreement may be terminated under the following circumstances:
- Mutual agreement of the Parties;
- Medical determination that the pregnancy cannot proceed.
9. Dispute Resolution
Any disputes arising under this Agreement shall first be mediated in good faith. If unresolved, the
dispute shall be submitted to binding arbitration under the laws of New York.
10. Governing Law
This Agreement shall be governed by the laws of the State of New York, USA.
11. Entire Agreement
This Agreement constitutes the entire understanding between the Parties and supersedes all prior
agreements.
