ACCOMPLISHMENT FOR CY 2024

Regulations and Permitting Section (RPS)

I. EXECUTIVE SUMMARY

In line with the goal of our department to improve its services to the general public
and to determine effectiveness of the programs, projects and activities delivered, and
despite of the challenges we are embracing in accomplishing our targets for the First
Semester, CY 2024, reporting and evaluation of our accomplishments are necessary. It
aims to determine performance of our agency to address issues and concerns that have
been encountered in the implementation of the programs and to serve as guide for the next
planning period.

The accomplishments of the Regulations and Permitting Section under the Technical
Services Division for the First Semester, CY 2024 cover the following field of activities, to
wit:

Through the collaborative efforts of Regulation and Permitting Section (RPS) staff
and personnel of the Technical Services Division (TSD), the support and assistance from
concerned stakeholders particularly LGUs and NGAs involved in land management and

disposition, issuance of tree cutting permit, inventory of water users, mapping of water
sources and issuance of local transport permits helped a lot in the attainment of all our
targets for the 1st Semester of CY 2024.
The filling up of one (1) vacant position for Land Management Inspector and hiring of
Contract of Service (CoS) personnel (Technical and Office Support Staff) augment the
manpower of the Section in the acceptance of patents and water permit applications which
contributed in accomplishing all the target activities for the First Semester.

Likewise, the financial utilization of the Section conformed to the Implementation


Plan and Monthly Disbursement Program (MDP) of the Section.

III. DETAILED NARRATIVE REPORT OF ACCOMPLISHMENTS

1. Land Survey, Disposition and Records Management

1.1 Residential Free Patent


Under Residential Patent Issuance (R.A. 10023), the Section through the Patent
and Deeds Unit was able to accomplish one hundred three (103) patents for the First
Semester out of the semi-annual target of one hundred (100) patents to be issued,
equivalent to 103% accomplishment.

1.2 Agricultural Free Patent

With the passage of R.A 11573, authorizing the acceptance, processing and
approval of application for agricultural patent, the Section was able to accomplish one
hundred thirty-five (135) patents out of the semi-annual target of one hundred thirty-five
(135) patents to be issued which is equivalent to 100% accomplishment.

1.3 Titling of School Sites and Government Lands for Public and Quasi-Public
Use (Special Patent)

Under this activity, the Section was able to issue eight (8) special patents for
quasi-public sites for the First Semester out of the semi-annual target of two (2)
equivalent to 400% accomplishment, while under school sites issuance of patent, we
were able to accomplish two (2) for the First Semester out of the semi-annual target of
two (2) equivalent to 100% accomplishment.

It is noteworthy to mention that this Office through the collaborative efforts and
partnership with the Local Government Unit of Buenavista, had successfully acquired
and granted a Special Patent under the name of DENR-PENRO Marinduque - Nursery
Site. This parcel of land is identified as Lot No. 105-C of Csd-4B-003972-D located in
Brgy. Malbog, Buenavista, Marinduque.

1.4 Public Land Survey

In support of patent issuance, free survey of untitled residential and agricultural


lands under Public Land Survey (PLS) through contract of service with Solar Surveying
Office was implemented under supervision of the Survey and Mapping Unit (SMU).

Out of fifty-one (51) public residential lots target, the unit was able to
accomplished eighty (80) lots or 157% accomplishment while ninety-seven (97) public
agricultural lots or 124% was accomplished out of the seventy-eight (78) public
agricultural lots target as of June, 2024.

1.5 Land disputes/cases resolved/decided

Under this activity, the Section had investigated one (1) case out of one (1)
semi-annual target which is equivalent to 100% accomplishment.

1.6 Take-over of a Foreshore Area


On March 7, 2024, the DENR-PENRO Marinduque through Engr. Cynthia
Lozano, SVEMS Simeon Diaz, LMOI Maria Aivy Sol and FR Jonathan Telan, with the
assistance of Brgy. Kagawad Fernando Larrosa and Brgy. Tanod Diana Gonzales of
LGU-Balanacan, had conducted the physical takeover of a foreshore area covered by
an expired Foreshore Lease Contract (IV-7) 18 (E-V-383) of Eden Labustan covering
959 sq. m. situated in Brgy. Balanacan, Mogpog, Marinduque.

The Notices to the Public were installed within the perimeter of the area to inform
the public that the area is now taken over by the DENR, thus, no other person acting
upon on its behalf has no legal authority nor any right whatsoever to occupy, possess,
and exercise any act of ownership over the area.

2. Water Resource Utilization

2.1 Inventory of Water Users (Climate responsive output indicators)


Water Users and Water Sources Inventory
A total of twenty (20) water users and sources were inspected and listed in the
inventory by this Office from January to June 2024, of which four (4) are located in Sta.
Cruz, two (2) in Boac, eight (8) in Mogpog, four (4) in Torrijos, one (1) in Gasan and one
(1) in Buenavista, all in the Province of Marinduque.

The annual total target of water users and sources inventory is sixteen (16),
therefore, this Office accomplished 125% out of the annual target. (Refer to Table 2.1
for the list of establishments inspected and using groundwater) for CY 2024.

2.3 Water Permit Application

Acceptance and verification of Water Permit Application is targeted for the 4 th


Quarter of the 2nd Semester, hence, this Office has no accomplishment this 1st Semester.

2.4 Hiring of one (1) Technical Support Staff

The DENR MIMAROPA Regional Office downloaded the fund to hire one (1)
Technical Support Staff under the Technical Services Division/ Regulations and
Permitting Section/ Water Resources Utilization Unit to assist the WRUU Focal for the
additional targets given by the WRMO/NWRB.

In compliance to that, this Office hired one (1) Technical Support Staff (Ms.
Kristine Joy Palmero) to perform such duties as follows;

1. Conduct of water inventory;


2. Identify and map water sources;
3. Collects/generate water supply and sanitation data;
4. Identify and conduct ground validation potential water impoundment
site/water supply projects;
5. Monitor ongoing water-related projects of the national government,
including but not limited to NIA projects and DPWH projects;
6. Assist in the processing of water permits; and
7. Perform other tasks as instructed by his/her supervisor and WRMO.

3. Forest Resource Utilization

The DENR-PENRO Marinduque promotes sustainable forestry which includes


responsible cutting of trees, registration of private tree plantations, registration of
chainsaws, issuance of transport permits for trees harvested in private lands, and
collaboration with the Monitoring and Enforcement Section (MES) in the intensified
monitoring of illegal activities and other related activities that help forestry sector become
sustainable.

Most of the frontline services particularly on forestry that were catered by the
PENRO Marinduque were administered by Regulation Permitting Section-Forest
Resource Utilization Unit. The permits that were issued are vital to ensure that every
activity in the Province related to forestry and forestry services were monitored and in
conformity with the existing rules and regulation of the DENR.

These permits or clearances are composed mainly of cutting permits, transport


permits, registration of private plantations, and chainsaw registration. These frontline
services are all enrolled in the Citizen's Charter and subject to monitoring through the
SPICS.

3.1 Issuance/Processing of Tenurial Instruments

For the 1st semester of CY 2024, our Section was already able to process one
(1) application for Gratuitous Special Use Permit (GSUP) of the DPWH-Marinduque
District Engineering Office represented by Engr. Richard Emmanuel Ragrario located in
Brgy. Timbo, Buenavista, Marinduque which is equivalent to 100% accomplishment of
the annual target, though it was targeted for the 3rd Quarter of the 2nd Semester.

3.2 Issuance/Processing of Tree Cutting Permit

Under this activity, our Section was able to process and approve permit to cut
trees affected by the infrastructure projects of the DPWH/NGAs or Special Tree Cutting
Permit (STCP) with a total of twenty-three (23) applications/permits and three (3) Tree
Cutting Permit (TCP). In addition to the aforementioned, a total of fourteen (14) Private
Land Timber Permits (PLTP) were issued to titled land owners for the Semester. A total
of forty (40) cutting harvesting permits were issued out of the semi-annual target of
twenty-three (23), equivalent to 174% accomplishment. (Refer to Table 3.1 for Harvesting
Cutting Permit Application distribution respectively).

3.3 Issuance of Transport Certificate to Planted Trees within Private Land and
Tenured Forest Plantation

This is a legal document required to accompany the transport of harvested


timber from Titled Alienable and Disposable Lands. For the month of January to June
2024, the Section processed/issued a total of eleven (11) Certificate of Verification (COV)
transport permits. (Table 3.2 below shows where most lumbers were derived from)

3.3 Registration of Chainsaw


Chainsaw Registration is also the frontline service being offered by the
Section. It serves as a legal proof of ownership to regulate the use and possession of
chainsaws in the Philippines. The DENR shall issue different permits or certifications for
the purchase or import, manufacture, selling, re-selling, disposal, distribution, transfer of
ownership, lease, rental or lending chainsaws.

A total of forty-four (44) chainsaws were registered for the First Semester, CY
2024 of which twelve (12) are new and thirty-two (32) are for renewal.

4.1 Issuance of Wildlife Permit


4.1 Issuance/Processing of Local Transport Permit

Local Transport Permit (LTP) is a permit authorizing a Wildlife


Farm/Collector’s Permit holders to bring, carry, or ship wildlife, by-products or
derivatives acquired from legal sources within the Province of Marinduque to the final
destination within the country.

For January to June CY 2024, PENRO Marinduque was able to issue a total
of 542 LTPs to the permittees with Wildlife Farm Permit (WFP) and Wildlife Collector’s
Permit (WCP) equivalent to 127% accomplishment of the semi-annual target. (Refer to
table 4.1 for the monthly distribution of LTPs issued for the 1st Semester)

This Office through the personnel from WRPU headed by CDO II Lady Alyanna
M. Valderrama together with FR Menchita D. Radovan conducted compliance monitoring
on the Certificate of Wildlife Registration (CWR) of Mr. Eric L. Oria, holder of Marinduque
CWR No. 0015-05 located in Brgy. Cawit, Boac, Marinduque on March 12, 2024.

Based on the monitoring conducted, the following are the observations and
recommendations recorded:

V. ISSUES AND CONCERNS

The herein stated accomplishment of the Regulation and Permitting Section for First
Semester, CY 2024 was through collaborative efforts of all staff and personnel of the
Section. The placement of vacant position (Land Management Inspector) under the Patents
and Deeds Unit helped a in the attainment of the Section’s target for the First Semester.

Nevertheless, filling up of the vacant position for Engineer II still needs to be done to
complete the manpower of the Section.

Generally, the accomplishment of the Regulation and Permitting Section for the First
Semester, CY 2024 were accomplished beyond expectations. We would like to express
appreciation for the hard work and cooperation of all the staff and personnel of the Section
both permanent and Contract of Service (CoS). Also, we would like to extend our
appreciation to our Chief, Technical Services Division, In-Charge, Management Services
Division, and to the OIC-PENR Officer for their support and assistance.
