HP Softpaq Online License Agreement PLEASE READ CAREFULLY: THE USE OF SOFTWARE AVAILABLE AT THIS SITE IS SUBJECT TO THE

TERMS AND CONDITIONS THAT FOLLOW. IF YOU AGREE TO THESE TERMS, PLEASE CHOOSE THE I ACCEPT OPTION LOCATED ADJACENT TO THE SCREEN WHERE THIS AGREEMENT IS DISPLAYED. IF YOU DO NOT AGREE TO THESE LICENSE TERMS, PLEASE CHOOSE THE I DO NOT ACCEPT OPTION AND DO NOT DOWNLOAD ANY SOFTWARE FROM THIS SITE. Agreement To Contract Electronically: You (the Licensee) and HP agree to contract electronically. This means that when you choose the I Accept option with your mouse, you acknowledge your agreement to these terms and conditions and that your are doing so with the intent to sign a contract with HP electronically. Capacity and Authority to Contract: You represent that you are of the legal age of majority in your state of residence and, if applicable, you are duly authorized by your employer to enter into this contract. License: This Agreement grants Licensee a license to use, copy, and distribute, at the location where your HP computer system is installed, this Softpaq file (the Software) in object code form only. The files created by this Software may be subject to preexisting software licenses that continue to apply. Licensee may not (a) disassemble, reverse engineer, or decompile the Software, or (b) grant any person rights in the Software. Licensee may not alter, change, or remove from the Software any proprietary mark or proprietary rights notice. Licensee must also reproduce and include the copyright notice or other proprietary rights notice on any copy, modification, or portion of this software merged or combined with another program. Ownership: All right, title, and interest in the Software and in any ideas, know-how, code, or intellectual property associated with the Software shall at all time remain solely and exclusively with HP or, as the case may be, the publisher(s) of the Software. No Warranties: The Software and accompanying written materials are provided as is, without warranties either express or implied. HP disclaims, to the extent permitted by law, any warranties of merchantability, fitness for a particular purpose, and non-infringement of third-party rights. Limitation of Liability: Notwithstanding any damages that you might incur, the entire liability of HP and any of its suppliers under any provision of this EULA and your exclusive remedy shall be limited to the greater of the amount actually paid by you for the software product or US$1, whichever is greater. IN NO EVENT WILL HP BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES IN CONNECTION WITH OR ARISING OUT OF THIS AGREEMENT OR THE USE OR INABILITY TO USE THE SOFTWARE (INCLUDING LOSS OR INTERRUPTION OF BUSINESS, REVENUE, PROFITS, USE, SYSTEMS, DATA, INFORMATION, PROGRAMS, OR OTHER ECONOMIC ADVANTAGE), HOWEVER SUCH DAMAGES ARISE AND EVEN IF LICENSEE HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES. Term: This Agreement and the license granted hereunder shall become effective upon indication by Licensee of acceptance of the terms of this Agreement as evidenced by Licensee choosing the I Accept option adjacent to the screen where this Agreement is displayed and shall remain in effect until and unless HP provides notice of termination. Reservation of Rights: HP reserves all rights not expressly granted to you in this EULA. Transfer: The initial user of this software product may make a one time transfer of the software product to another end user. The transfer must not be an indirect transfer, such as a consignment. Prior to the transfer, the end user receiving the transferred product must agree to all of the EULA

terms. Upon transfer of the software product, your license is automatically terminated. You may not rent, lease, or lend the software product nor use the software product for commercial timesharing or bureau use. You may not sublicense, assign or transfer the license except as expressly provided in this EULA. COMPLIANCE WITH LAW. You shall comply with all laws and regulations of the United States and other countries (Export Laws) to assure that the Software Product is not (1) exported, directly or indirectly, in violation of Export Laws, or (2) used for any purpose prohibited by Export Laws, including, without limitation, nuclear, chemical, or biological weapons proliferation. Disputes arising in connection with this Agreement will be governed by the laws of the country and locality in which HP accepts the order. Entire Agreement: This Agreement constitutes the entire understanding and agreement of the parties with respect to the subject matter of this Agreement. No amendment, modification, or release from any provision of this Agreement shall be valid unless effected by mutual agreement by the parties in writing.
