ADR Clause for a Team As disputes arise within a team dynamic resolutions will become necessary for the team to continue functioning effectively. Therefore, an Alternate Dispute Resolution clause will be in effect for the team and each individual. The ADR clause will immediately go into effect upon disputes arising from any of the following: 1. One or more team members does not participate or refuses to participate as agreed upon by the team in the team charter. 2. The assignment of or agreement to individual sections of the team assignment, especially in regards to disagreements arising from two or more individuals who want to do the same section of the assignment and cannot agree to defer to the other(s). 3. Any behavior that negatively affects any other member(s) of the team. 4. Non-communications, wherein the individual(s) ignore or refuse to communicate with the team on problems or issues that might have arisen during their individual work that will affect the team as a whole. In the event that a dispute arises, the parties involved agree henceforth to team-wide negotiations in an attempt to resolve said dispute. Through negotiations the parties involved will adhere to the standard code of conduct and appropriate behavior for which is expected of them via the Universitys code of student conduct. All parties will negotiate their position and discuss what he or she feels is an appropriate resolution to the dispute. Members of the team who are not involved in the dispute will assist in negotiations. In the event that a resolution cannot be agreed upon through negotiation the dispute will enter into conciliation, wherein the instructor will be involved. The instructor will have absolute power to make all decisions regarding the resolution of the dispute and his or her decision will be binding for all parties involved.
