INDUSTRIAL EMPLOYMENT STANDING ORDER ACT 1946

Standing orders which regulates the conditions of employment from the stage of entry to the organization by an employee. By the operation of this act all industrial establishment will have to frame terms & conditions of service with regarding to all the matters specified in the schedule

SCOPE AND APPLICATION OF THE ACT


This Act extends to the whole of India except Jammu & Kashmir. It is applied to every industrial establishment were 100 or more work men are employed .

1.Classification Of Work men . 2.Termination Of Employment:3.Closing & reopening of industrial establishment:-

4.Matter relating to workmen period:5.Remedy measures for work men against unfair treatment

6.Suspension or dismissal for misconduct


7. Shift working.

8.Attendence & late comings.

Procedure for certification of standing order


Employer shall submit to the certifying officer 5 copies of the draft and application in form no. 1 Certifying officer shall forward the copy to union of other representative The union or representative may file objections After hearing certifying officer shall certify the draft with necessary modification

THE POWER OF CERTIFYING OFFICER: The certifying under this act means, a labor commissioner or a regional labor commissioner or other officers appointed by the govt: time to time for certification. Every certifying officer shall have all the power of a civil court i.e., receiving evidence and enforcing the attendance of the witness.

MODIFICATION OF CERTIFIED STANDING ORDER: It cannot be modified until the expiry of six months from the date on which it comes into operation but after that can be modified. The conditions of modification are A change of circumstances has occurred The applicant feel that the modification any be more beneficial
