INDUSTRIAL RELATIONS

OBJECTIVE
To learn following sections of ID ACT,1947 Section 21 Section 22 Section 23 Section 24 Section 25

SECTION 21:CERTAIN MATTERS TO BE KEPT CONFIDENTIAL

No confidential matters should be disclosed in awards or settlements that are obtained by court, tribunal ,national tribunal, arbitrator or conciliation officer without the consent. Nothing contained in this section shall apply to disclosure of any information for the purpose of prosecution under section 193 of IPC

SECTION 22:PROHIBITION OF STRIKES AND LOCK-OUTS No person employed in a public utility service shall go on strike unless A strike notice must be given to employer before 6 weeks The strike must not take place within 14 days Strike must not take after 6 weeks Strike must not take place during conciliation proceedings and 7 days after conclusion of such proceedings

No employer carrying on any public utility service shall lock-out unless A lock-out notice must be given by the employer before 6 weeks. The lock-out must not take place within 14 days Lock-out must not take place after 6 weeks Lock-out must not take place during conciliation proceedings and 7 days after conclusion of such proceedings

SECTION 23:GENERAL PROHIBITION OF STRIKES AND LOCK-OUTS


No workmen or employer shall go on strike or lock out When conciliation is going on before a board of conciliation and 7 days thereafter When adjudication is going on before a labour court or tribunal and two months thereafter When arbitration is going on before an arbitrator and 2 months thereafter. When settlement or award is in operation (matters that are covered by settelement or award)

COMPARISION OF SECTION 22 AND 23 Section 22 applies to public utility concerns only. Section23 applies to both public utility as well as non public utility concerns

Under section 22 notice of strike and lock out is necessary under 23 no such notice is required.

SECTION 24:ILLEGAL STRIKES AND LOCK-OUTS


A strike or lock-out will be illegal if It is commenced or declared in contravention of sec 22 or 23 It is continued in contravention of an order made under subsection 4A of section 10A A lock-out declared in consequence of an illegal strike or a strike declared in a consequence of an illegal lock-out shall be deemed to be illegal.

SECTION 25:PROHIBITION OF FINANCIAL AID TO ILLEGAL STRIKES AND LOCK-OUTS


No person shall knowingly expend or apply any money in direct furtherance of support of any illegal strike or lock-out
