According to the Indian Contract Act of 1872, acceptance of a proposal occurs when the person to whom the proposal is made signifies their assent to it. ACCEPTANCE HOW MADE ?
Acceptance may be expressed or implied. It is express
when the acceptance has been signified in writting , or by word of mouth , or by performance of some required act.
Acceptance is implied when it is to be gathered from
the surrounding circumstances or the conduct of the parties. In the case of specific offer, it can be accepted only by the person to whom it is made.
Essentials of a valid acceptance :
(a) Absolute and unqualified
(b) Communicated to the offeror (c) According to the mode prescribed (d) Within the specified time (e) In responseto an offer (f) Before the lapse of offer (g) By the offeree only Law does not allow making of an agreement in the future. The parties must agree on terms of the agreement . The terms of the agreement must be either definite or capable of being made definite without further agreement of the parties.
