 The foundation of the Mexican environmental law is article 40 of the Mexican
Constitution

of the law.”
GENERAL LAW OF ECOLOGICAL BALANCE AND

The federal rule that regulates the rights and obligations in the environmental field is
the "General Law of Ecological Balance and Environmental Protection" this has four
regulations:

It is a fact that small firms have difficulty to comply with the legislation for lack of
economic resource of complying with environmental requirements.
Transnational corporations are promoters of exchange of technology in its
subsidiaries by

 Implementing a marketing strategy by the environmental technical knowledge in their processes
LAWS AND ENVIRONMENTAL STANDARDS
The Federal Attorney for Environmental Protection (PROFEPA)
• corresponds with the companies through visits of inspection, if it detects failure of the rule promotes
an agreement with the company where undertakes to carry out corrective measures in time.
The National Water Law (LAN)
• establishes the National Water Commission as the authority on national waters, regulates the
discharge of sewage, regulates the control of the extraction and use of groundwater and surface
water, promotes the prevention and control of pollution of the waters.
The General Health Law
• Article 3 establishes as a matter of general health the prevention and control of the harmful effects
of environmental factors on the health of the man
• Article 373 states that the industrial establishments, commercial or service require sanitary license,
which has to do with the impact that their activities generate on the environment and human health.

OFFICIAL MEXICAN STANDARDS (NOM)
To determine which laws and official Mexican standards (NOM) is subject the
company, we must proceed from its activity, size and their technological level.
The regulations for the industrial sector is specified in the NOM-ECOL, mainly
concerned with the theme of water, air pollution, hazardous waste and noise
emissions.
The environmental performance of the company envisages the following factors:

Another fact to consider is the need to bring environmental standard to the current
needs of the market, industry and the environment
Key factors may be the transformation of the market, the evolution of the technology,
the interest of the client, the decline in the nature of non-renewable resources, the
increase in the ecological footprint in reaction to a pattern of consumerism.
The duty of the rule of law is less than the duty of the employer, although the object
of environmental law is the protection and conservation of the environment, the
employer should comply with environmental legal on the basis of a minimum personal
ethics, which comes from understanding of their direct relationship with biodiversity.
