1996 FISHERIES AND

AQUATIC LAW
SECTION 93. ILLEGAL USE OF
SUPERLIGHT.

*it shall be unlawful to engage in fishing with the use


of superlights in municipal water

*violation of this provision shall be punished by


imprisonment from 6 months to 2 years or a fine of
five thousand pesos
SECTION 94. CONVERSION OF
MANGROVES.

It shall be unlawful for any person to convert


mangroves into fishponds or for any other purposes

Violation of this provision shall be punished by


imprisonment from 6 years and 1 day to 12 years or
a fine of eighty thousand pesos
SECTION 95. FISHING IN OVERFISHED
AREA AND DURING CLOSED SEASON.

It shall be unlawful to fish in over fish area and during


closed season.

Violation of the provision of this section shall be


punished by imprisonment of 6 months and one day to
6 years and fine of 6,000 and for the forfeiture of the
catch and cancellation of fishing permit or license.
SECTION 96. FISHING IN FISHERY
RESERVES, REFUGE AND SANCTUARIES.
It shall be unlawful to fish in fishery areas declared by
the department as fishery reserves , refuge and
sanctuaries.

Violation of the provision of this section shall be


punished by imprisonment of 2 years to 6 years and
fine of 2,000 pesos to 20,000 pesos and for the forfeiture
of the catch and cancellation of fishing permit or
license.
SECTION 97. FISHING OR TAKING
RARE, THREATENED OR ENDANGERED
SPECIES.

It shall be unlawful to fish or take rare , threatened or


endangered species as listed in the CITES and as
determined by the department .

Violation of the provision of this section shall be


punished by imprisonment of 12 years to 20 years and
fine of one hundred and twenty-thousand pesos and
for the forfeiture of the catch and cancellation of
fishing permit or license.
SECTION 98. CAPTURE OF SABALO
AND OTHER BREEDERS/SPAWNERS.
It shall be unlawful for any person to catch , gather ,
culture or possess mature milkfish or sabalo and such
other breeders or spawners of other fisheries species as
may be determined by the department.

Violation of the provision of this section shall be


punished by imprisonment of six months and one day
to 8 years and a fine of 80,000 pesos and forfeiture of
the catch and cancellation of fishing permit or license.
