 The Batasang Pambansa shall create a


Sandiganbayan, which shall have jurisdiction over criminal and
civil cases involving graft and corrupt practices and such other
offenses committed by public officers and employees,
including those in government-owned or controlled corporations, in relation to
their office as may be determined by law. (Art. XIII), 1973 Constitution.
 The present anti-graft court known as the Sandiganbayan shall continue to
function and exercise its jurisdiction as now or hereafter may be provided by
law. (Art. XI), 1987 Constitution.

Issue: Sandiganbayan jurisdiction over the person of the accused because the
Information filed with the Sandiganbayan did not mention that the offense committed
by the accused is office-related
Held: We hold that the petitioners are estopped from assailing the jurisdiction of the
Sandiganbayan for in the supplemental arguments to motion for reconsideration and/or
reinvestigation filed with the same court, it was they who “challenged the jurisdiction of
the Regional Trial Court over the case and clearly stated in their Motion for
Reconsideration that the said crime is work connected. We therefore hold that the
Sandiganbayan has jurisdiction over the case because of estoppel and it was thus
vested with the authority to order the amendment of the Information.

HELD: Those that are classified as Grade 26 and below may still fall within the
jurisdiction of the Sandiganbayan provided that they hold the positions
enumerated by the law, and that it was committed in
relation to their office.

ISSUE: Sandiganbayan jurisdiction over acts of lasciviousness
HELD: The Sandiganbayan shall exercise exclusive original jurisdiction in all
cases involving offenses or felonies whether simple or complexed with other
crime committed by the public officials and employees. Esteban is vested with
the power to recommend the appointment of Ana May Simbajon as bookbinder.
But he imposed a condition before extending such recommendation - she
should be his girlfriend and must report daily to his office for a kiss. There can
be no doubt, therefore, that petitioner used his official position in committing the
acts complained of.
