Statute of Fraud

The statute of fraud is a legal concept that stipulates
that certain types of contracts must be executed in
writing to be valid.
The following promises are within the statute of frauds
1. A special promise of an executor or administrator to answer
any debt or damage out of his own estate.

2. A special promise to personally assume the debt, default or


miscarriage of another person.
3. An agreement made upon the consideration of marriage.

4. Certain agreements not to be performed within the space of


one year from the making thereof.

5. A contract for the sale of land, tenements or hereditaments,


or the disposal of any interests in them for a longer period than
one year.
