Before presenting our PPT on the
topic of Fundamental right, I would
like to thank our teacher for
inspiring us to increase about The
Indian Constitution and Social
sciences.
Definition
Fundamental rights are essential human
rights that are offered to every citizen
irrespective of caste, race, creed, place
of birth, religion or gender. These are
equal to freedoms and these rights are
essential for personal good and society at
large.
Six Fundamental rights
 The right to equality
 The right to freedom
 The right to freedom from exploitation
 The right to freedom of religion
 Cultural and educational rights
 The right to constitutional remedies
Right to equality
 Right to Equality (Articles 14-18): Article 14 says that state
shall not deny to any person equality before the law or the
equal protection of the laws within the territory of India.
 The right of Social Equality and Equal Access to Public Areas
is clearly mentioned under the Article 15 of the Constitution
of India stating that no person shall be shown favoritism on
the basis of color, caste, creed language, etc. Every person
shall have equal admittance to public places like public
wells, bathing Ghats, museums, temples etc.
Fundamental Rights – Right to Freedom

(Article 12 to 35) of the Constitution of India protects the


fundamental rights, the basic and civil liberties of the
people of India. The fundamental rights are applicable to all
the citizens of the country, irrespective of their religion,
race, caste, creed, place of birth or gender. The
fundamental rights are protected by the judiciary of India
and in case of their violation, a person can approach the
Supreme court directly for justice as per Article 32 of the
constitution. However, here we shall discuss the right to
freedom.
Directive Principles of State Policy

 These are included in Part IV of the Constitution. For the framing


of certain Laws, the Government requires certain guidelines.
These are included in the Directive Principles of State Policy.
According to Article 37, they are not enforceable by the courts. It
just lays down the fundamental principles and guidelines on
which they are based are fundamental guidelines for governance
that the State need to follow while designing the laws. Emphasis
is on the Welfare of State Model.
 The establishment of Directive Principles of State Policy is in
accordance with certain articles of the Constitution of India. Let
us explore more about the importance of these articles.
The Fundamental Duties
 These are defined as the moral obligations of all citizens to help
promote a spirit of patriotism and to uphold the unity of India and
concern the individuals and the nation. Included in Part IVA of the
Constitution, like the Directive Principles, they are not enforceable by
the law. According to the constitution, following are the duties to be
followed by every citizen of India
 To abide by the Constitution and respect its ideals and institutions, the
National Flag and the National Anthem.
 To cherish and follow the noble ideals which inspired our national struggle for
freedom.
 To uphold and protect the sovereignty, unity, and integrity of India.
 To defend the country and render national service when called upon to do so.
The Fundamental Duties
 To value and preserve the rich heritage of our composite culture.
 To protect and improve the natural environment including forests,
lakes, rivers, wildlife and to have compassion for living creatures.
 To develop the scientific temper, humanism and the spirit of
inquiry and reform.
 To safeguard public property and to abjure violence.
 To strive towards excellence in all spheres of individual and
collective activity, so that the nation constantly rises to higher
levels of endeavor and achievement.
The Relationship Between the Fundamental Rights, Directive
Principles and Fundamental Duties

 Directive Principles have been used to uphold the


Constitutional validity of legislation in case of conflict
with Fundamental Rights. According to the amendment
of 1971,  any law that even though it deviates from the
Fundamental Rights, but has been made to give effect
to the Directive Principles in Article 39(b)(c) would not
be deemed invalid. The Fundamental Duties will be
held obligatory for all citizens subject to the State
enforcing the same by means of a valid law.
Conclusion
Rights are those conditions of life
without which are essential for the all
round development of personality of
individuals. Rights and duties are closely
related. In the absence of one, the
other becomes meaningless.
